RESOLUTION NO. 5361 BY: <br /> <br /> AN EMERGENCY RESOLUTION accepting the recommendation of the Board <br />of Trustees of Lakewood Hospital to institute legal action to oppose the <br />proposed Westlake Health Campus Association project and authorizing said <br />Board to employ, at Hospital expense, special legal counsel in connection <br />fherewith. <br /> <br /> WHEREAS, the Board of Trustees of Lakewood Hospital has advised <br />this~council that it believes that the proposed Westlake Health Campus <br />Association project will place 200 unneeded beds in the westshore area, <br />thus unreasonably and unnecessarily increasing health care costs for the <br />residents of the City of Lakewood and northeastern Ohio, and <br /> <br /> WHEREAS, the Board of TrUstees of Lakewood Hospital has determined~ <br />that said project would adversely affect and is contrary to the best intersts <br />of the citizens of the City of Lakewood and northeastern Ohio, and <br /> <br /> WHEREAS, the Board of Trustees of LakeWood Nospital has recommended <br />that legal action be instituted to oppose the proposed Westlake Health Campus <br />Association project and to engage legal counsei in connection therewith, and <br /> <br /> WHEREAS, this Council concurs in the determination and recommendation <br />of the Board of Trustees of Lakewood Hospital regarding said project, and <br /> <br /> WHEREAS, this resolution is declared to be an emergency measure <br />providing for the immediate preservation of the health and w~lfare and for <br />the further reason that legal action opposing the proposed Westlake Health <br />Campus Association project should be initiated without delay; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br />Approved: <br /> <br /> Section 1. That this Council hereby accepts and concurs in the <br />recommendation of t'he Board of Trustees of Lakewood Hospital to institute <br />legal action to oppese the proposed West]ake Health Campus Association project. <br /> <br /> Section 2. That this Council hereby authorizes and directs the <br />Board of Trustees of Lakewood Hospital to employ, at Hospital expense, not <br />to exceed $55,000, special counsel, Isaac Schulz, amd the taw firm of Ford, <br />Whitney, Crump and Schulz, Cleveland, Ohio to represent the City of Lakewood <br />in opposing sai. d project. <br /> <br /> Section 3 That this resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in forse immediately upon its adoption and approval by <br />the Mayor; otherwise it shall take effect and be in force from and after the <br />earliest period allowed by law. <br /> <br /> ~> .', iPresiden~'~ <br /> ~Clerk <br /> <br /> <br />
