RESOLUTION NO. 5363 <br /> <br />BY: Wendling, Brockman, Brown, Chinnock, <br /> McBride, Salmon <br /> <br /> A RESOLUTION declarlng the intent of the City of Lakewood to support <br />the water quality management plan developed for the Northeast Ohio Area. <br /> <br /> WHEREAS, pursuant to Section 208 of the Clean Water Act, Public Laws <br />92-500 and 95-217, the Administrator of the United States Environmental Protection <br />Agency (USEPA) has promulgated regulations for identification of those areas <br />which, as the result of urban industrial concentration, or other factors, have <br />substantial water quality control problems (40 CRF 130); and <br /> <br /> WHEREAS, the Governor of the State of Ohio on May 26, 1975, pursuant <br />to Section 208 of the Clean Water Act, designated the Northeast Ohio Areawide <br />Coordinating Agency (NOACA) as the planning agency for the seven-county Northeast <br />Ohio Area, consisting of the counties of Ouyahoga, Geauga, Lake, Lorain, Medina, <br />and the Lake Erie Basin portion of Portage and Summit; and <br /> <br /> WHEREAS, it is necessary that management agencies agree to support the <br />Water Quality Management Plan; and <br /> <br /> WHEREAS, the Water Quality Manag!ement Plan for Northeast Ohio designates <br />the City of Lakewood as a management agenoy; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the City of Lak,ewood recognizes the existence of <br />substantial water quality control problems and supports the adoption of the Water <br />Quality Management Plan for the Northeast Ohio Area as the plan exists on <br />January 3, ]979. <br /> <br /> Section 2. It is understood tha~t the Water Quality Management Plan <br />for the Northeast Ohio Area will be subjec~t to an annual review, at which time <br />management agency responsibilities and functions may be revised, and upon such <br />revisions the Council of the City of Lakewood will consider a resolution of <br />support for substantial revisions to such plan. <br /> <br /> Section 3- It is further the ~ntent of the City of Lakewood that any <br />and all management agency responsibilities shall be the subject of an agreement <br />to implement, which agreement will be cons!idered by the City of Lakewood and <br />entered into upon approval of the agreement by and authorization pursuant to a <br />resol'ution adopted by the Council of the City of'Lakewood. <br /> <br /> Section 3.
