i <br /> RESOLUTION N0. 5406 BY:M~Nally, Salmon, Wendling, <br /> Brown, Chinnock, McBride <br /> A RESOLUTION expressing the concern of this Council relative to <br /> the conditions existing at the Lakewood Nursing Home as disclosed at a Public <br /> Hearing and requesting the Director of Health to institute an action for <br /> injunctive relief pursuant to Ohio Revised Code Section 3721.08. <br /> WHEREAS, a Public Hearing was held on June 21, 7,979 at Lakewood <br /> City Hall to review the conditions presently existing at Uhe Lakewood Nursing <br /> Home, 13330 Detroit Avenue, Lakewood, Ohio, and <br /> WHEREAS, testimony was received that alleged serlious violations <br /> of State and Federal law including patient abuse, unsanitary conditions, lack <br /> of proper supervision, lack of adequate staffing and othett violations of law, <br /> and <br /> WHEREAS, said testimony presented is on file in transcript form in <br /> the Office of the Clerk of Council and hereby incorporated by reference herein <br /> as if the same were fully rewritten herein, and <br /> WHEREAS, this Council is of the opinion as a result of the testimony <br /> presented at the Public Nearing, that there is a real and present danger to <br /> health or safety of the residents of the Lakewood Nursing Home; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKIEWOOD, STATE OF <br /> OHIO: <br /> Section 1. That this Council expresses its concern relative to <br /> the conditions existing at the Lakewood Nursing Home as described at a Public <br /> Hearing and as set forth in the aforementioned transcript and this Council is <br /> of the opinion that there is a real and present danger to the health or safety <br /> of the residents of Lakewood Nursing Home. <br /> Section 2. That this Council hereby requests th'e Director of Health <br /> of the State of Ohio institute an action for injunctive relief pursuant to <br /> Section 3721.08 of the Ohio Revised Code. <br /> Section 3. That the Clerk of Council be and she is hereby authorized <br /> and directed to forward a certified copy of this resolutioh to the Director of <br /> Health of the State of Ohio, John H. Ackerman, M. D., Governor James Rhodes, <br /> Lt.
