RESOLUTION NO. <br /> <br />5416 <br /> <br />BY: Chinnock, McBride, McNally, <br /> Salmon, Wendling, Brockman, <br /> BrOwn <br /> <br /> AN EMERGENCY RESOLUTION requesting the DireCtor of Transportation <br />of the State of Ohio to review the Engineering and Traffic Investigation for <br />the purpose of declaring a reasonable and safe prima-facte speed limit for <br />the entire length of Sloane Avenue from West Clifton Boulevard to the Detroit <br />Avenue bridge approach in the City of Lakewood. <br /> <br /> WHEREAS, complaint has been made to this Council that the <br />statutory vehicular speed limit established by Section 4511.21 of the Ohio <br />Revised Code for Sloane Avenue between West Clifton Boulevard and the Detroit <br />Avenue bridge approach is greater than that considered tO be reasonable and' <br />safe, and <br /> <br /> WHEREAS~ this Council has caused to be made!an Engineering and <br />Traffic Investigation upon said Sloane Avenue, and <br /> <br /> WHEREAS, this Council has determined, upon the basis of said <br />Engineering and Traffic Investigation, that the prima-fa¢ie speed limit under <br />Sections 4511.01 to 4511.80, inclusive, and 4511.99 of the Ohio Revised Code <br />on the aforementioned Sloane Avenue, to wit, 35 miles per hour, is greater <br />than is reasonable and safe under the conditions found t~ exist at such <br />location, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and <br />for the usual daily operation of a municipal department;inow, therefore, <br /> <br />OHIO: <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section I. Pursuant to the provisions of section 4511.21 of the <br />Ohio Revised Code, the Director of Transportation of the!State of Ohio is hereby <br />requested to review the Engineering and Traffic Investigation and to determine <br />and declare a reasonable and safe prima-facie speed limit, to wit, twenty-five <br />(25) miles per hour, for the entire length of Sloane Avenue from West Clifton <br />Boulevard to the Detroit Avenue bridge approach in the City of Lakewood. <br /> <br /> Section 2. That upon notification by the Director of Transportation <br />that the prima-facie speed limit has been altered, this Council acknowledges <br />that such altered speed limit shall become effective only when appropriate signs <br />giving notice thereof are erected at such location. <br /> <br /> Section 3. That the Clerk of Council be and she is hereby authorized <br />and directed to forward a certified copy of this resolutfon, together with a <br />copy of the City's Engineering and Traffic InvestigationI, to the Director of <br />Transportation of the State of Ohio. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble!hereof and provided it <br />receives the affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediateTy upon its adoption and approval <br />by the Mayor. //~~ ~ <br /> <br /> <br />
