RESOLUTION NO. <br /> <br />5427 <br /> <br />B¥~ Brockman, Brown, Chinnock, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY RESOLUTION declaring it necessary to improve~certain streets in the <br />City of Lakewood by removal, where necessary, of the existing Surface course; by <br />grading and replacement, where necessary, of the base; and by ~esurfaclng with <br />asphaltic concrete including the necessary replacement and resetting of castings together <br />with necessary appurtenances thereto. <br /> <br /> WHEREAS, this Council by two-thirds vote of the members elected thereto determines <br />that this resolution is an emergency measure whieh is necessary for the immediate <br />preservation of the public peace, property, health and safety and for-the further <br />reason that the improvements herein provided are immediately necessary to eliminate <br />existing hazards to vehicular traffic using the streets of this City; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City,of Lakewood, Cuyahoga <br />County, State of Ohio, three-fourths of all members elected thereto concurring: <br /> <br /> Section 1. That it is necessary to improve in the City of Lakewood the following <br />streets: <br /> <br /> 1. Victoria Avenue, from Madison to Hilliard <br /> 2. Bunts Road, from Detroit to railroad <br /> 3. Thrush, from Halstead to Quail and from Lark to Magee <br /> 4. Delaware Avenue, from Lakeland to Brown <br /> 5. Atkins, from S. Marginal to Fischer <br /> 6. Atkins, from Hilliard to S. Marginal <br /> 7. Whipporwill <br /> 8. Clifton Place <br /> 9. Adeline <br />10o Hilda <br /> <br /> Section 2. That said streets shall be improved in accord&nce with specifications <br />hereinafter referred to and now on file in the office of the City Engineer by the <br />removal, where necessary, of the existing surface course~ by grading and replacement, <br />where necessary, of the base; and by resurfacing with asphaltic concrete including <br />the necessary replacement and resetting of castings together with necessary appurtenances' <br />thereto. <br /> <br /> Section 3. It is hereby determined and declared that said improvement is <br />conducive to the public health, convenience and welfare of said,City and the inhabitants <br />thereof. <br /> <br /> Section 4. That the plans, specifications and estimates Of the proposed improve- <br />ment, heretofore prepared and now on file in the office of the!.City Engineer, are <br />hereby approved. <br /> <br /> Section 5. Council hereby determines that the lots and l~nds bounding and abutting <br />upon the proposed improvements are specially benefitted by sai~ improvements. Those <br />lots with frontage so benefitted by said improvements shall be!assessed at the rate of <br />$5.50 per foot of frontage. Those lots with side yards benefitted by anv of the said <br />improvements shall be assessed an amount equal to the average for all lots having <br />frontage on the improved portion of that street plus $5.50 perlfoot for any lot depth <br />in excess of 150 feet. It is estimated that these assessmentslshall cover approximately <br />50 percent of the actual cost of said improvement, to wit: th~ cost of preliminary and <br />other surveys, plans, specifications, profiles and estimates and of printing, serving and <br />publishing notices, resolutions and ordinances, the ~mount of damages resulting from the <br />improvement assessed in favor of any owner of land affected bylthe improvement and the <br />interest thereon, the costs incurred in connection with the preparation, levy, and <br /> <br /> <br />
