RESOLUTION NO. 5427 B¥~ Brockman, Brown, Chinnock, McBride, Salmon, Wendling AN EMERGENCY RESOLUTION declaring it necessary to improve~certain streets in the City of Lakewood by removal, where necessary, of the existing Surface course; by grading and replacement, where necessary, of the base; and by ~esurfaclng with asphaltic concrete including the necessary replacement and resetting of castings together with necessary appurtenances thereto. WHEREAS, this Council by two-thirds vote of the members elected thereto determines that this resolution is an emergency measure whieh is necessary for the immediate preservation of the public peace, property, health and safety and for-the further reason that the improvements herein provided are immediately necessary to eliminate existing hazards to vehicular traffic using the streets of this City; NOW, THEREFORE, BE IT RESOLVED by the Council of the City,of Lakewood, Cuyahoga County, State of Ohio, three-fourths of all members elected thereto concurring: Section 1. That it is necessary to improve in the City of Lakewood the following streets: 1. Victoria Avenue, from Madison to Hilliard 2. Bunts Road, from Detroit to railroad 3. Thrush, from Halstead to Quail and from Lark to Magee 4. Delaware Avenue, from Lakeland to Brown 5. Atkins, from S. Marginal to Fischer 6. Atkins, from Hilliard to S. Marginal 7. Whipporwill 8. Clifton Place 9. Adeline 10o Hilda Section 2. That said streets shall be improved in accord&nce with specifications hereinafter referred to and now on file in the office of the City Engineer by the removal, where necessary, of the existing surface course~ by grading and replacement, where necessary, of the base; and by resurfacing with asphaltic concrete including the necessary replacement and resetting of castings together with necessary appurtenances' thereto. Section 3. It is hereby determined and declared that said improvement is conducive to the public health, convenience and welfare of said,City and the inhabitants thereof. Section 4. That the plans, specifications and estimates Of the proposed improve- ment, heretofore prepared and now on file in the office of the!.City Engineer, are hereby approved. Section 5. Council hereby determines that the lots and l~nds bounding and abutting upon the proposed improvements are specially benefitted by sai~ improvements. Those lots with frontage so benefitted by said improvements shall be!assessed at the rate of $5.50 per foot of frontage. Those lots with side yards benefitted by anv of the said improvements shall be assessed an amount equal to the average for all lots having frontage on the improved portion of that street plus $5.50 perlfoot for any lot depth in excess of 150 feet. It is estimated that these assessmentslshall cover approximately 50 percent of the actual cost of said improvement, to wit: th~ cost of preliminary and other surveys, plans, specifications, profiles and estimates and of printing, serving and publishing notices, resolutions and ordinances, the ~mount of damages resulting from the improvement assessed in favor of any owner of land affected bylthe improvement and the interest thereon, the costs incurred in connection with the preparation, levy, and
