RESOLUTION NO, 5444 <br /> <br />BY: Chinnock, Gallagher, Graham, McBride, <br /> Salmon,.Wendling, Brown <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Directori of Law to file <br />a motion to intervene and, if granted, join the City olf Parma as a party <br />de~endant in an action in the United States D~strict Court, Northern <br />District of Ohio, entitled Record Revolution No. 6 v. ~ity of Parma, <br />et al. (Case No. C80-38). <br /> <br /> WHEREAS, the above named plaintlff has filed an action requesting <br />the Court enjoin the City of Parma from enforcing an ordinance prohibiting <br />the sale of drug related paraphernalia, and, <br /> <br /> WHEREAS, the City of Lakewood shall enact or has~ enacted an ordi- <br />nance similiar to the Parma City ordinance relating to the prohibition <br />of the sale of drug related paraphernalia, and, <br /> <br /> WHEREAS, this Council is of the opinion that the City of Lakewood <br />has a substantial interest in the action entitled Record Revolution No. 6 <br />vo City of Parma, et alo (Case No. C80~38) and as a practical matter, the <br />City of Lakewood will be impaired or impeded from the ability to protect <br />its interests unless fully represented, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing <br />for the immediate preservation of the public safety, health and welfare <br />in that immediate steps should be taken to abate an exlistlng public <br />nuisance and provides for the usual daily operation of~a municipal depart- <br />ment; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Law be and he is hereby authorized <br />to prepare and file a motion to intervene in the case entitled, Record <br />Revolution No. 6 v. City of Parma, et al. (Case No. C80-38) and, if per- <br />mitted by the Court, join the City of Parma in order to represent the City <br />of Lakewood's interests relating to the ordinance prohibiting the sale of <br />drug related paraphernalia° <br /> <br /> Section 2. That this Resolution ]s hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it re- <br />ceives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force ~mmediately upon its adoption <br />and approval by the Mayor, otherwise it shall take effect and be ]n force <br />from and after the earliest period allowed by law. <br /> <br />~V~,i~ce~2e s/~'ident ~ ~ <br /> Clerk ~/ <br /> <br /> <br />
