RESOLUTION NO. ~ <br /> <br /> AN E~RGENCY RESOLUTION objecting to the renewa~ of a D-5 liquor <br />penmit issued to G~I., Inc. /dba/ Brass Bell Saloon, for a~ establishment <br />located at 16201 Hilliard Avenue in the City of Lskewood, Ohio and requesting <br />a hearing. <br /> <br /> WH~aiEAS, a D-5 liquor permit has been issed by the Ohio Department <br />of Liquor Control to G.I., Inc. /dba/ Brass Bell Saloon for an establishment <br />located at 16201 Hilliard Avenue, Lakewood, Ohio, and <br /> <br /> I~EREAS, said liquor perm_it will be up for renewal on or about <br />....... ~ctober 1, 1980, and <br /> <br /> WHEREAS, the applicant for said permit has operated said liquor <br />permit business in a nmnner that demonstrates a disregard Ifor the laws, <br />regulations and local ordinances of the State of Ohio and Ithe City of Lakewood, <br />and <br /> <br /> WHEREAS, this Council determines that the renewal of said permit would <br />be contrary to the best interests of the entire community .and would place <br />additional burdens upon the facilities of the Lakewood Police Department, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing <br />for the inrnediate preservation of the public health, safe~y and welfare; now, <br />therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWCOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That this Council hereby strenuously objects to the <br />renewal by the Department of Liquor Control of the Statelof Ohio of the D-5 <br />liquor permit issued to G.I., Inc. /dba/ Brass Bell Saloo~ for the premises <br />known as 16201 Hilliard Avenue, Lakewood, Ohio for the reSsons above set forth, <br />all in accordance with the previsions of Section 4303.2711and Section 4303.292 <br />of the Revised Code of Ohio. <br /> <br /> Section 2. That this Council, as the legislative authority of the <br />City of Lakewood, hereby requests a hearing on the foregoing objections as <br />provided in Section 4303.271 of the Revised Code of Ohio.. <br /> <br /> Section 3. That the Clerk of Council is hereby lauthorized and directed <br />to transmit two certified copies of this Resolution together with two copies <br />of a statement of the Law Director of the City of Lakewoo8 that in his opinion <br />the objection is based upon substantial legal grounds and!within the meaning and <br />intent of Division (A) of Section 4303.292 of the Revisedl Code, and two copies <br />of a letter requesting that the hearirg be held in Cleveland, Cuyahoga County, <br />to the Department of Liquor Control, State of Ohio, Permit Division, no later <br />than August 15, 1980. <br /> <br /> Section 4. That this Council designates the Law Department of the <br />City of Lakewood to represent it and the City of Lakewoodl at any hearings before <br />the Department of Liquor Control. <br /> <br /> Section 5, It is found and determined that alll fomal actions of this <br />Council concerning and relating to the passage of this resolution were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council andof any of its conTnittees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal reqnirements <br />including Sections 121,22 of the Ohio Revised Code. <br /> <br /> <br />
