RESOLUTION NO. 5499 <br /> <br />BYI: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br /> AN EMERGENCY RESOLUTION objecting to the transfer of D-5 and D-6 <br />liquor permits now held in safekeeping by the State of Ohio by applicant <br />Pradist & Sons Inc. /dba/ Touch of Japan to premises located at 14803 Madison <br />Avenue in the City of Lakewood, Ohio. <br /> <br /> WHEREAS, Pradist & Sons Inc. /dba/ Touch of Japan has applied to the <br />Department of Liquor Control, State of Ohio, for the transfer of D-5 and D-6 <br />liquor permits now held in safekeeping by the State of Ohio to the premises <br />known as 14803 Madison Avenue, Lakewood, Ohio, and <br /> <br /> WHEREAS, investigation discloses that the applicant and/or the <br />principal officer, director,manager or shareholder thereof has operated his <br />liquor permit businesses in a manner that demonstrates a disregard, for the laws, <br />regulations and/or local ordinances of the State of Ohio and the City of Lakewood, <br />and <br /> <br /> WHEREAS, the place for which the permits are sought is so located with <br />respect to the neighborhood that substantial interference!with the public <br />decency, sobriety, peace and/or good order would result fPom the transfer of <br />location of the permits and operation thereunder by the applicant, and <br /> <br /> WHEREAS, this Council determines that the transfer of location of <br />said liquor permits would be contrary to the best interests of the entire <br />community and would place additional burdens upon the facilities of the Lakewood <br />Police Department, and <br /> <br /> WHEREAS, this resolution constitutes an emergenCY measure in that it <br />provides for the immediate preservation of the public health, safety and welfare; <br />now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That this Council hereby strenuously objects to the <br />granting, by the Department of Liquor Control of the State of Ohio, of the <br />application of Pradist & Sons Inc. /dba/ Touch of Japan tO transfer D-5 and D-6 <br />permits now held in safekeeping by the State of Ohio to the premises known as <br />14803 Madison Avenue, Lakewood, Ohio all in accordance wi~h the provisions of <br />Section 4303.26 of the Revised Code of Ohio. <br /> <br /> Section 2. That the Clerk of Council is hereby'authorized and directed <br />to transmit two certified copies of this resolution, together with two copies of <br />a letter of objection and two copies of a letter'requesting that the hearing <br />be held in Cleveland, Cuyahoga County, Ohio, to the Department of Liquor Control, <br />State of Ohio, Permit Division, no later than November 27~ 1980. <br /> <br /> Section 3. That this Council designates the LaW Department of t~e City <br />of Lakewood to represent it and the City of Lakewood at a~y hearings before the <br />Department of Liquor Control. <br /> <br /> Section 4. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this reslolution were adopted <br />in an open meeting of this Council, and that all such deliiberations of this <br />Council and of any committees that resulted in such formall action were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br />Approved: <br /> <br /> Section 5.
