Section 1. That Section 1 of Resolution 5519' adopted. December 7, <br /> 1981, shall be and the same is hereby amended to read as follows: <br /> Section 1. That it is necessary to improve the following <br /> streets in the City of Lakewood: <br /> 1. Jackson Avenue (Merl Avenue to Clifton Boulevard); <br /> 2. Lincoln Avenue (Bayes Avenue to Lakewood Heights Boulevard); <br /> 3. Giel Avenue (Clifton Boulevard to N&W railroad tracks); <br /> 4. Lakewood Heights Boulevard (Alger Road to 1S0 feet west of <br /> Olive AvenueJ; <br /> 5. McKinley Avenue (Hilliard Road to Riverside Drive); <br /> 6. Cove Avenue (Edgewater Drive to Lake Avenue); <br /> 7. Lewis Drive (Madison Avenue to Lakewood Heights Boulevard); <br /> 8. Reveley Avenue (Madison Avenue to Athens Avenue); and <br /> 9. Alger Road (Warren Road to Lakewood Heights Boulevard). <br /> Section 2. That Section 5 of Resolution 5619 adopted December 7, <br /> <br /> 1982 shall be and the same is hereby amended to read as follows: <br /> Section 5. Council hereby determines that the lots and lands <br /> bounded and abutting upon-the proposed improvements are special- <br /> ly benefited by said improvements. Those lots with frontage <br /> so benefited by said improvements on: <br /> 1. Jackson Avenue (Merl Avenue to Clifton Boulevard); <br /> 2. Lincoln Avenue (Bayes Avenue to Lakewood Heights Boulevard); <br /> 3. Giel Avenue (Clifton Boulevard to N&W railroad tracks); <br /> 4. Cove Avenue (Edgewater Drive to Lake Avenue); and <br /> 5. Lewis Drive (Madison Avenue to Lakewood Heights Boulevard). <br /> shall be assessed at the rate of $5.00 per foot of frontage and <br /> on those lots with frontage so benefited by said improvements <br /> on Reveley Avenue (Madison Avenue to Athens Avenue) shall be <br /> assessed at the rate of $4.50 per foot of frontage and those <br /> lots with frontage so benefited by said improvements on: <br /> 1. Lakewood Heights Boulevard (Alger Road to 180 feet west of <br /> Olive Avenue); <br /> 2. McKinley Avenue (Hilliard Road to Riverside Drive); and <br /> 3. Alger Road (Warren Road to Lakewood Heights Boulevard) <br /> shall not be assessed and the entire cost of said improvement <br /> shall be paid for by the City. <br /> Those lots with side yards benefited by any of the said improve- <br /> ments shall be assessed an amount equal to the average for all <br /> lots having frontage on the improved portion of that street <br /> plus $5.00 per foot on Jackson, Lincoln, Giel, Cove Avenue <br /> and Lewis Drive and $4.50 per foot on Reveley Avenue and no <br /> assessment shall be made for Lakewood Heights Boulevard, <br /> McKinley Avenue or Alger Road for any lot in excess of 150 feet. <br /> It is estimated that ttiese assessments with the exception of Reveley <br /> Avenue, Lakewood Heights Boulevard, McKinley Avenue and Alger Road, <br /> shall cover approximately 50 percent of the actual cost of said <br /> improvement, to wit, the cost of preliminary and other surveys, <br /> plans, specifications profiles and estimates and of printing, <br /> serving and publishing notices, resolutions and ordinances, the amount <br /> of damages resulting from the improvement assessed in favor of any <br /> owner of land affected by the improvement and the interest thereon, <br /> the costs incurred in connection with the preparation, levy, <br /> and collection of the special. assessments., the cost of pur- <br /> chasing, appropriating, and otherwise acquiring therefor any <br /> required real estate or legal opinion, cost of labor and material <br /> -and interest on bonds and notes issued in anticipation of the <br /> levy and collection of the special assessments together with <br /> all other necessary expenditures. <br /> <br />
