RESOLUTION N0: 57$2-83 gY; Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> AN EMERGENCY RESOLUTION declaring it necessary to improve certain streets <br /> in the City of Lakewood by removal, where necessary, of the existing surface course, <br /> by grading and replacement where necessary, of the base and by resurfacing with <br /> asphaltic concrete including the necessary replacement and resetting of castings <br /> together with necessary appurtenances hereto. <br /> WHEREAS, this Council, by two-thirds vote of the members elected there- <br /> to, determines that this Resolution is an emergency measure which is necessary for <br /> the immediate preservation of the public peace, property,. health and safety and <br /> for the further reason that the improvements herein provided are immediately <br /> necessary to eliminate existing hazards to vehicular traffic using the streets <br /> of this City; now, therefore <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That it is necessary to improve the following streets in <br /> the City of Lakewood: <br /> 1. Morrison Avenue (:Madison to Delaware); <br /> 2. Marlowe Avenue .(Franklin to Madison); <br /> 3. Clarence Avenue (Detroit to Hazelwood); <br /> 4. Elmwood Avenue (Detroit to Madison); and <br /> 5. Lakeland Avenue (Detroit to Clifton). <br /> Section 2. That said streets shall be improved in accordance with speci- <br /> fications hereinafter referred to and now on file in the office of the City Engineer <br /> by removal, where necessary, of the existing surface course, by grading and replace- <br /> ment where necessary, of the base, and by resurfacing with asphaltic concrete in- <br /> cluding the necessary replacement and resetting of castings together with necessary <br /> appurtenances thereto. <br /> Section 3. It is hereby determined and declared that said improvement <br /> is conducive to the public health, convenience and welfare of said City and the <br /> inhabitants thereof.. <br /> Section 4. That the plans, specifications and estimates of the proposed <br /> improvements, heretofore prepared and now on file in the office of the City Engineer, <br /> are hereby approved. <br /> Section 5. Council hereby determines that the lots and lands abounding <br /> and abutting upon the proposed improvements are specially benefitted by said im- <br /> provements. Those lots with frontage so benefitted by said improvements shall be <br /> assessed at the rate of $5.70 per foot of frontage. Those lots with side yards <br /> benefitted by any of the said improvements shall be assessed an amount equal to <br /> the average for all lots having frontage on the improved portion of the street <br /> plus $5.70 per foot for any lot depth in excess of 150 feet, It is estimated <br /> <br /> that these assessments shall cover approximately 50 percent of the actual cost <br /> of said improvement, to wit: the cost of preliminary and other surveys, plans, <br /> specifications, profiles, and estimates and of printing, serving and publishing <br /> notices, resolutions and ordinances, the amount of damages resulting from the <br /> improvement assessed in favor or any owner of land affected by the improvement <br /> and the preparation, levy, and collection of the special assessments, the cost <br /> <br /> of purchasing, appropriating, and otherwise acquiring labor and material and <br /> interest on bonds and notes issued in anticipation of the levy and collection <br /> <br /> of the special assessment together with all other necessary expenditures. <br /> <br />
