RESOLUTION N0. 5791-83 BY: Brown, Gallagher, Graham, <br /> McBride, Wenlding <br /> A RESOLUTION objecting to the renewal of the C2 liquor permit issued <br /> to Jane General and Violet J. Tarcai d/b/a Unity Market Place for an establish- <br /> ment located at 12701 Madison Avenue in the City of Lakewood and requesting a <br /> hearing. <br /> WHEREAS, a C2 liquor permit has been issued by the Ohio Department of <br /> Liquor Control to Jane General and Violet J. Tarcai for an establishment <br /> located at 12701 Madison Avenue, Lakewood, Ohio, and <br /> WHEREAS, said liquor permit will be up for renewal on or about <br /> October 1, 1983, and <br /> WHEREAS, on or about November 7, 1980, Violet J. Tarcai, one of the <br /> named permit holders was determined to have sold beer to an underaged person <br /> and was found guilty of said crime which this Council believes relates to her <br /> fitness to operate a liquor establishment, and <br /> WHEREAS, the applicants for said permit have operated their liquor per- <br /> mit business in a manner that demonstrates a disregard for the laws, regulations <br /> and local ordinances of the State of Ohio and the City of Lakewood, and <br /> WHEREAS, this Council determines that the renewal of said permit is <br /> contrary to the best interest of the entire community and would place additional <br /> burdens upon the facilities of the Lakewood Police Department and that the <br /> renewal of said liquor permit should be objected to; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That this Council hereby strenuously objects to the <br /> renewal by the Department of Liquor Control of the State of Ohio of the C2 <br /> liquor permit issued to Jane General and Violet J. Tarcai d/b/a Unity Market <br /> Place for premises known as 12701 Madison Avenue, Lakewood, Ohio, for the <br /> reasons set forth above all in accordance with the provisions of Sections <br /> 4303.271 and 4303.292(A) of the Ohio Revised Code. <br /> Section 2. That this Council as the legislative authority hereby <br /> requests a hearing on the foregoing objection as provided in Section 4303.271 <br /> of the Ohio. Revised Code. <br /> Section 3. That the Clerk of Council is hereby authorized and direct- <br /> ed to transmit two certified copies of this Resolution, together with two <br /> copies of a statement from the Law Director of the City of Lakewood that in his <br /> opinion the objection is based upon substantial legal grounds within the <br /> meaning and intent of Division A of Section 4303.292 of the Ohio Revised Code, <br /> and two copies of a letter requesting that the hearing be held in Cleveland, <br /> Cuyahoga County, to the Department of Liquor Control, State of Ohio, Permit <br /> Division, no later than August 31, 1983. <br /> Section 4. That this Council designates the Law Department of the <br /> City of Lakewood to represent it and the City of Lakewood at any hearings <br /> before the Department of Liquor Control. <br /> Section 5.
