RESOLUTION N0. 5791-83 BY: Brown, Gallagher, Graham, McBride, Wenlding A RESOLUTION objecting to the renewal of the C2 liquor permit issued to Jane General and Violet J. Tarcai d/b/a Unity Market Place for an establish- ment located at 12701 Madison Avenue in the City of Lakewood and requesting a hearing. WHEREAS, a C2 liquor permit has been issued by the Ohio Department of Liquor Control to Jane General and Violet J. Tarcai for an establishment located at 12701 Madison Avenue, Lakewood, Ohio, and WHEREAS, said liquor permit will be up for renewal on or about October 1, 1983, and WHEREAS, on or about November 7, 1980, Violet J. Tarcai, one of the named permit holders was determined to have sold beer to an underaged person and was found guilty of said crime which this Council believes relates to her fitness to operate a liquor establishment, and WHEREAS, the applicants for said permit have operated their liquor per- mit business in a manner that demonstrates a disregard for the laws, regulations and local ordinances of the State of Ohio and the City of Lakewood, and WHEREAS, this Council determines that the renewal of said permit is contrary to the best interest of the entire community and would place additional burdens upon the facilities of the Lakewood Police Department and that the renewal of said liquor permit should be objected to; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council hereby strenuously objects to the renewal by the Department of Liquor Control of the State of Ohio of the C2 liquor permit issued to Jane General and Violet J. Tarcai d/b/a Unity Market Place for premises known as 12701 Madison Avenue, Lakewood, Ohio, for the reasons set forth above all in accordance with the provisions of Sections 4303.271 and 4303.292(A) of the Ohio Revised Code. Section 2. That this Council as the legislative authority hereby requests a hearing on the foregoing objection as provided in Section 4303.271 of the Ohio. Revised Code. Section 3. That the Clerk of Council is hereby authorized and direct- ed to transmit two certified copies of this Resolution, together with two copies of a statement from the Law Director of the City of Lakewood that in his opinion the objection is based upon substantial legal grounds within the meaning and intent of Division A of Section 4303.292 of the Ohio Revised Code, and two copies of a letter requesting that the hearing be held in Cleveland, Cuyahoga County, to the Department of Liquor Control, State of Ohio, Permit Division, no later than August 31, 1983. Section 4. That this Council designates the Law Department of the City of Lakewood to represent it and the City of Lakewood at any hearings before the Department of Liquor Control. Section 5. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
