RESOLUTION N0. 5862-84 BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> AN EMERGENCY RESOLUTION repealing Resolution 5850-84 which objected <br /> to the transfer of ownership of D2, D2X, and D6 liquor permits from Nicholas <br /> Moissis d/b/a Greek House, to Gene Summa for premises located at 11728 Detroit <br /> Avenue, City of Lakewood. <br /> WHEREAS, Gene Summa has applied to the Department of Liquor Control, <br /> for transfer of ownership of D2, D2X, and D6 liquor permits from Nicholas <br /> Moissis d/b/a Greek House for the premises at 11728 Detroit Avenue, Lakewood, <br /> Ohio, and <br /> WHEREAS, said application did not conform to the building, safety and <br /> health requirements and the requirements of Rule LCc-1-17 and Rule LCc-1-28 of <br /> the Regulations of the Liquor Control Commission, and <br /> WHEREAS, this Council did originally object in Resolution 5850-84, and <br /> WHEREAS, said applicant has now changed his application to <br /> conform to the Regulation of the Liquor Control Commission and the building, <br /> health and safety requirements of the City of Lakewood, and <br /> WHEREAS, this resolution constitutes an emergency measure in that it <br /> provides for the immediate preservation of the public health, safety and <br /> welfare; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That this Council does hereby repeal Resolution 5850-84 ob- <br /> jecting to the application of Gene Summa for transfer of ownership from <br /> Nicholas Moissis d/b/a Greek House of D2, D2X and D6 liquor permits for <br /> premsies located at 11728 Detroit Avenue, Lakewood, Ohio. <br /> Section 2. That this Council designates the Law Department of the <br /> City of Lakewood to represent it and the City of Lakewood at the Department of <br /> Liquor Control in withdrawing its objection to said transfer. <br /> Section 3. That this resolution is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and provided it <br /> receives the affirmative vote of two-thirds of all members of Council, it shall <br /> take effect and be in force immediately upon its adoption and approval by the <br /> Mayor; otherwise, it shall take effect and be in force after the earliest <br /> period allowed by law. <br /> Adopted: ( ~ ~j ,~,,,~1~,~ <br /> ~ <br /> <br /> Approved: /~L~ d0~~ O <br /> ® l~fA <br /> OAR <br /> <br />
