RESOLUTION NO. 6005-85 BY'Gallagher, Graham, McBride, <br /> Salmon, Wendling <br /> AN EMERGENCY RESOLUTION authorizing and directing the Mayor <br /> ex-officio Director of Public Safety to enter into a contract or <br /> contracts for the purchase of up to eight new motor vehicles and three <br /> used motor vehicles for the Division of Police, Department of Public <br /> Safety. <br /> WHEREAS, present motor vehicles in the Division of Police <br /> are of such age and condition as to require continual repair resulting <br /> in extended periods of time when they are not available for use <br /> because of such needed repair, with some vehicles having odometer <br /> readings in excess of 9p,9H0 miles, and <br /> WHEREAS, the current motor vehicles fail to provide a degree <br /> of reliability and are no longer cost efficient to maintain and should <br /> be replaced with new motor vehicles, and <br /> WHEREAS, this Resolution constitutes an emergency measure in <br /> that it provides for the immediate preservation of the public safety <br /> and welfare and for the usual daily operation of a municipal <br /> department; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> Section 1. That the Mayor ex-officio Director of Public <br /> Safety be and he is hereby authorized and directed to enter into a <br /> contract or contracts for the purchase of up to eight new and three <br /> used motor vehicles plus related equipment, and for the sale or trade- <br /> in of Police Department vehicles, with the lowest and best bidder or <br /> bidders after advertisement according to law. <br /> Section 2. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of this <br /> resolution were adopted in an open meeting of this Council, and that <br /> all such deliberations of this Council and of any of its committees <br /> that resulted in such formal action, were in meetings open to the <br /> public, in compliance with all legal requirements including Section <br /> 121.22 of the Ohio Revised Code. <br /> Section 3. That this resolution is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and <br /> provided it receives the affirmative vote of two-thirds of all members <br /> elected to Council, it shall take effect and be in force immediately <br /> upon its adoption and approval by the Mayor; otherwise, it shall take <br /> effect and be in force after the earliest period allowed by law. <br /> Adopted: I (o ~ ( ~J ~ C~ <br /> U SIDENT (Acting) <br /> RK <br /> I <br /> <br /> Approved: <br /> ~IYOR <br /> <br />
