RESOLUTION N0. 6p27-86 BY: Brown, Gallagher, Graham, <br /> McBride, Salmon., Wend7ing <br /> A RESOLUTION o jecting to the transfer of C1 and C2 liquor <br /> permits by applicant adison Rib House, Inc.to an establishment <br /> located at 15527 Madison Avenue, Lakewood, Ohio. <br /> WHEREAS, Mad .son Rib House, Inc. has applied to the <br /> Department of Liquor Con rol, State of Ohio for the trasnfer of C1 and <br /> <br /> C2 liquor permits to he premises known as 15527 Madison Avenue, <br /> Lakewood, Ohio, and <br /> WHEREAS, an in estigation discloses that the place for which <br /> the permit is sought is so located with respect to the neighborhood, <br /> that substantial interfe ence with public decency, sobriety, peace, or <br /> good order would result rom the transfer of the permits and operation <br /> thereunder by the applic nt, and <br /> WHEREAS, the n ber of those permits already in existence in <br /> the locality is such hat the granting of the transfer would be <br /> detrimental to and substantially interfere with the morals, safety or <br /> welfare of the public, and <br /> WHEREAS, this ~ Council determines that the place for which <br /> the permit is sought does not conform to the Buiding Code of the City <br /> of Lakewood, and <br /> WHEREAS, this Council determines that the granting of the <br /> transfer of the aforem ntioned permits is contrary to the best <br /> interest of the enti e community and would place additional <br /> burdens upon the facilit'es of the Lakewood Police Department, now, <br /> therefore, <br /> BE IT RESOLVED Y THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO, <br /> Section 1. Th t this Council hereby strenuously objects to <br /> the granting by the Depar ment of Liquor Control of the State of Ohio <br /> of the application of Ma ison Rib House, Inc. to transfer Cl and C2 <br /> liquor permits to the premises known as 15527 Madison Avenue, <br /> Lakewood, Ohio, all in accordance with the provisions of Section <br /> 43p3.292 of the Ohio Revi ed Code. <br /> Section 2. Th t the Clerk of Council is hereby authorized <br /> and directed to transm t two certified copies of this Resolution, <br /> together with two copies f a letter of objection and two copies of a <br /> letter requesting that he hearing be held in Cleveland, Cuyahoga <br /> County, to the Departure t of Liquor Control, State of Ohio, Permit <br /> Division, no later than F bruary 6, 1986. <br /> Section 3. Tha this Council designates the Law Department <br /> of the City of Lakewood to represent it and the City of Lakewood at <br /> any hearings before the D partment of Liquor Control. <br /> Section 4. I is found and determined that all formal <br /> actions of this Council c ncerning and relating to the passage of this <br /> resolution were adopted in an open meeting of this Council, and that <br /> <br />
