RESOLUTION No. 6033-86 BY: Brown, Chinnock, Gallagher, Graham, McBride; Salmon, Wendling AN EMERGENCY RESOLUTION declaring it necessary to improve certain streets in the pity of Lakewood by removal where necessary of the existing surface ~rourse, by grading and replacement where necessary of the base, and by resurfacing with asphaltic concrete together with necessary appurtenances thereto. WHEREAS, this Council by two-thirds vote of the members elected thereto, deter~5ines that this Resolution is an emergency measure which is necessary for the immediate preservation of the public health and saf$ty and for the further reason that the improvements herein prc}vided are immediately necessary to eliminate existing hazards to vehicular traffic using the streets of this City; now, therefore, BE IT RESOLVEDIBY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. 7jhat it is necessary to improve the following streets in the City of Lakewood: 1. Phelps; 2. Atkins (Hilliard to Madison); 3. Victoria (Hilliard to Detroit); and 4. Nicholson ( etroit to Lake). Section 2. :That said streets shall be improved in accordance with specificaltions hereinafter referred to and now on file in the Office of the Cit Engineer by removal where necessary of the existing surface course, ~by grading and replacement where necessary of the base, and by resurfacing with asphaltic concrete including the necessary replacement Viand resetting of castings together with necessary appurtenances thereto. Section 3. I is hereby determined and declared that said improvement is conducive o the public health, convenience and welfare of said City and the inha itants thereof. Section 4. Th~t the plans, specifications and estimates of the proposed improvements heretofore prepared and now on file in the Office of the City Engine~r are hereby approved. Section 5. C¢~uncil hereby determines that the lots and lands abounding and abjatting upon the proposed improvements are specially benefitted by s id improvements. Those lots with frontage so benefitted by said i provements shall be assessed at the rate of $6.50' per foot of frontag Those lots with side yards benefitted by any of the said improveme~its shall be assessed an amount equal to the average for all lots haling frontage on the improved portion of the street plus $6.50 per fo t for any lot depth in excess of 150 feet. It is estimated that th se assessments shall cover approximately 50 percent (500) of the actu 1 cost of said improvement, to wit,. the cost of preliminary and other urveys, plans, specifications, profiles and estimates and of printing serving and publishing notices, resolutions and ordinances, the amou~t of damages resulting from the improvement assessed in favor of any caner of land affected by the improvement and the preparation, levy, a d collection of the special assessments, the cost of purchasing, appr priating, and otherwise acquiring labor and material and interest on onds and notes issued in anticipation of the levy and collection of t e special assessment together with all other necessary expenditures. 1 I
