<br /> RESOLUTION No. 6033-86 BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride; Salmon, Wendling <br /> AN EMERGENCY RESOLUTION declaring it necessary to improve <br /> certain streets in the pity of Lakewood by removal where necessary of <br /> the existing surface ~rourse, by grading and replacement where <br /> necessary of the base, and by resurfacing with asphaltic concrete <br /> together with necessary appurtenances thereto. <br /> WHEREAS, this Council by two-thirds vote of the members <br /> elected thereto, deter~5ines that this Resolution is an emergency <br /> <br /> measure which is necessary for the immediate preservation of the <br /> public health and saf$ty and for the further reason that the <br /> improvements herein prc}vided are immediately necessary to eliminate <br /> existing hazards to vehicular traffic using the streets of this City; <br /> now, therefore, <br /> BE IT RESOLVEDIBY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> Section 1. 7jhat it is necessary to improve the following <br /> streets in the City of Lakewood: <br /> 1. Phelps; <br /> 2. Atkins (Hilliard to Madison); <br /> 3. Victoria (Hilliard to Detroit); and <br /> 4. Nicholson ( etroit to Lake). <br /> Section 2. :That said streets shall be improved in <br /> accordance with specificaltions hereinafter referred to and now on file <br /> in the Office of the Cit Engineer by removal where necessary of the <br /> existing surface course, ~by grading and replacement where necessary of <br /> the base, and by resurfacing with asphaltic concrete including the <br /> necessary replacement Viand resetting of castings together with <br /> necessary appurtenances thereto. <br /> Section 3. I is hereby determined and declared that said <br /> improvement is conducive o the public health, convenience and welfare <br /> of said City and the inha itants thereof. <br /> Section 4. Th~t the plans, specifications and estimates of <br /> the proposed improvements heretofore prepared and now on file in the <br /> Office of the City Engine~r are hereby approved. <br /> Section 5. C¢~uncil hereby determines that the lots and <br /> lands abounding and abjatting upon the proposed improvements are <br /> specially benefitted by s id improvements. Those lots with frontage <br /> so benefitted by said i provements shall be assessed at the rate of <br /> $6.50' per foot of frontag Those lots with side yards benefitted by <br /> any of the said improveme~its shall be assessed an amount equal to the <br /> average for all lots haling frontage on the improved portion of the <br /> street plus $6.50 per fo t for any lot depth in excess of 150 feet. <br /> It is estimated that th se assessments shall cover approximately 50 <br /> percent (500) of the actu 1 cost of said improvement, to wit,. the cost <br /> of preliminary and other urveys, plans, specifications, profiles and <br /> estimates and of printing serving and publishing notices, resolutions <br /> and ordinances, the amou~t of damages resulting from the improvement <br /> assessed in favor of any caner of land affected by the improvement and <br /> the preparation, levy, a d collection of the special assessments, the <br /> cost of purchasing, appr priating, and otherwise acquiring labor and <br /> material and interest on onds and notes issued in anticipation of the <br /> levy and collection of t e special assessment together with all other <br /> necessary expenditures. <br /> 1 <br /> I <br /> <br />
