<br /> RESOLUTION No. 6036-86 BY: &rown, Ghinnock, Gallagher, Graham., <br /> McBride, Salmon, Wendling <br /> A RESOLUTION ~3eclaring the inability of the City to agree <br /> with the owners of the real property located at 1276 Clifton Prado, <br /> Lakewood, Ohio, as to the amount of compensation for the appropriation <br /> of a portion of said plroperty; declaring the intention to obtain <br /> possession of said property at the time of filing suit in <br /> appropriation; directing the Director of Finance to cause a check to <br /> be issued in favor of Fraocis J. Talty, Judge of the Probate Court of <br /> Cuyahoga County in the amount of $861.53 representing the value of <br /> such property appropriated and Directing the Director of Law to <br /> deposit said check in a court of competent jurisdiction at the time of <br /> filing the suit for appropriation. <br /> WHEREAS, on February 18, 1986, this Council duly adopted <br /> Resolution No. 60341-86 declaring the necessity and intent of the City <br /> of Lakewood to appropriate a portion of the real property located at <br /> 1276 Clifton Prado, Lakewood, Ohio, owned by Edna M. Wick and Viola <br /> Shafer and being a portion of Permanent Parcel No. 312-29-105, and <br /> WHEREAS, on Mhrch 18, 198b, this Council duly adopted <br /> Ordinance No.2g-86 t~ proceed with the appropriation of the <br /> aforesaid property, and <br /> WHEREAS, the C~ty is unable to agree with Edna M. Wick and <br /> Viola Shafer, the owners`thereof, as to the amount of compensation to <br /> be paid to said owners, avid <br /> WHEREAS, the aforementioned property to be appropriated is <br /> to be used for the purpose of constructing a roadway open to the <br /> public without charge inlthe City of Lakewood in conjunction with the <br /> City's Clifton Prado Improvement Project and therefore, possession of <br /> said property should b~ obtained at the time of filing suit in <br /> accordance with the law irk such cases made and provided, and <br /> WHEREAS, said property should be appropriated and possession <br /> taken immediately so a to facilitate the construction of the <br /> aforementioned road an~ the completion of the Clifton Prado <br /> Improvement Project at th~ earliest possible time; now, therefore, <br /> BE IT RESOLVED ~Y THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> Section 1. Tljat the City of Lakewood is unable to agree <br /> with Edna M. Wick and Viola Shafer, the owners of the aforesaid <br /> property, as to the amo nt of compensation to be paid to said owners <br /> for the designated portion of such property. <br /> Section 2. Than the Director of Finance be and he is hereby <br /> authorized and directedi to cause a check to be drawn in favor of <br /> Francis J. Talty, Judge o~ the Probate Court of Cuyahoga County in the <br /> amount of $861.53 representing the value of such property appropriated <br /> together with damages, iflany, to the residue. <br /> Section 3. T13at the Director of Law is hereby authorized <br /> and directed to deposit] the aforementioned check in a court of <br /> competent jurisdiction atl the time of filing suit for appropriation <br /> representing the value q'f such property appropriated together with <br /> damages, if any, to the residue. <br /> Section 4.
