<br /> A RESOLUTION objecting to the renewal of D1, D2, D3 and D3A
<br /> liquor permits issued to Maxes, Inc. d/b/a Maxes for an establishment
<br /> located at 13405 Madison Avenue, Lakewood, Ohio, and requesting a
<br /> hearing.
<br /> WHEREAS, D1, D2, D3 and D3A liquor permits have been issued
<br /> by the Ohio Department of Liquor Control to Maxes, Inc, d/b/a Maxes
<br /> for an establishment located at 13405 Madison Avenue, Lakewood, Ohio,
<br /> and
<br /> WHEREAS, said liquor permits will be up for renewal on
<br /> October 1, 1986, and
<br /> WHEREAS, the applicant for said permits has operated said
<br /> liquor permit business in a manner that demonstrates a disregard for
<br /> the laws, regulations, and local ordinances of the State of Ohio and
<br /> the City of Lakewood, and
<br /> WHEREAS, this Council determines that the renewal of said
<br /> permits is contrary to the best interest of the entire community and
<br /> would place additional burdens upon the facilities of the Lakewood
<br /> Police Department, and that the renewal of said liquor permit should
<br /> be objected to; now, therefore,
<br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE
<br /> OF OHIO:
<br /> Section 1. That this Council hereby strenuously objects to
<br /> the renewal by the Department of Liquor Control of the State of Ohio
<br /> of the D1, D2, D3 and D3A liquor permits issued to Maxes, Inc. d/b/a
<br /> Maxes for premises located at 13405 Madison Avenue, Lakewood, Ohio,
<br /> for the reasons set forth above, all in accordance with the provisions
<br /> of Section 430'3.271 and Section 4303.292 of the Ohio Revised Code.
<br /> Section 2. That this Council, as the legislative authority
<br /> of the City of Lakewood, hereby requests a hearing on the foregoing
<br /> objections as provided in Section 4303.271 of the Ohio Revised Code.
<br /> Section 3. That the Clerk of Council is hereby authorized
<br /> and directed to transmit a certified copy of this Resolution, together
<br /> with a statement by the Law Director of the City of Lakewood that in
<br /> his opinion the objection is based upon substantial legal grounds
<br /> within the meaning and intent of Division A of Section 4303.292 of the
<br /> Ohio Revised Code, and a letter requesting that the hearing be held in
<br /> Cleveland, Cuyahoga County, to the Department of Liquor Control., State
<br /> of Ohio, Permit Division no later than August 31, 1986.
<br /> Section 4. That this Council designates the Law Department
<br /> of the City of Lakewood to represent it and the City of Lakewood at
<br /> any hearings before the Department of Liquor Control.
<br /> Section 5. It is found and determined that all formal
<br /> actions of this Council concerning and relating to the passage of this
<br /> ordinance were adopted in an open meeting of this Council, and that
<br /> all such deliberations of this Council and of any of its committees
<br /> that resulted in such Formal action, were in meetings open to the
<br /> public, in compliance with all legal requirements including Section
<br /> 121.22 of the Ohio Revised ®C ode.
