Deferred until Next Regular Meeting of Council <br /> March 16, tg87 <br /> RESOLUTION N0. 6107-86 BY: grown, Chinnock, Gallagher, McBride, <br /> Salmon, Wendling <br /> A RESOLUTION contirming the order of the Board of Building Standards <br /> dated November 10, 1986 relative to property located at 1080 Abbieshire <br /> Avenue, Lakewood, Ohio (Permanent Parcel No. 312-01-044) and notifying the <br /> property owner of the action to be taken by this municipality if compliance <br /> is not accomplished. <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the decision of the Board of Building Standards dated <br /> November 10, 1986, relative to the property located at 1080 Abbieshire <br /> Avenue, Lakewood, Ohio (Permanent Parcel No 312-01-044) which reads as <br /> follows: <br /> The Board determined that the structure located at 1080 Abbieshire <br /> Avenue, Lakewood, Ohio constitutes a public nuisance structure <br /> pursuant to the standards as set forth in Section 1305.521 of the <br /> Housing Code. The Board further finds that the property owner has <br /> failed to comply with various notices and orders from the Building <br /> Department dating back to July 1969 as set forth in Mr. Paul Jindra°s <br /> communication dated October 29, 1986 (a part of the evidence before <br /> the Board, a copy of which is attached hereto). <br /> The Board hereby orders the property owner, Donald Schubert, to repair <br /> the structure forthwith and to complete required repairs within ninety <br /> days (90) from the date of service of the Council resolution. <br /> Acceptable evidence of the commencement of repairs shall be the <br /> obtaining of the required permits from the City of Lakewood Building <br /> Department and executed contracts filed with the Building Department. <br /> Section 2. That by receipt of this Resolution, the property owner, <br /> Donald Schubert, is hereby notified to comply with the decision and order <br /> of the Board of Building Standards as confirmed by this Council. The <br /> property owner, Donald Schubert, is further notified by receipt of this <br /> Resolution that if he fails, neglects or refuses within ninety days (90) <br /> from the date of service of this Resolution to comply with the decision and <br /> order of the Board to complete repairs as confirmed by Council, the <br /> Building Commissioner is hereby authorized and directed to advertise for <br /> bids and to enter into a contract or contracts with the lowest and best <br /> bidder or bidders after advertisement according to law for the repair of <br /> said structure, and the City acting through the Building Commissioner, <br /> shall cause said structure to be repaired in accordance with the decision <br /> and order of the Board as confirmed by City Council. <br /> Section 3. That the Clerk of Council is hereby authorized and <br /> directed to serve a certified copy of this Resolution to Donald Schubert in <br /> accordance with the provisions of Section 1305.521 (d) of the Housing Code <br /> of the Codified Ordinances of the City of Lakewood. <br /> Adopted `p/ ~~0 / ` <br /> resi ent <br /> Clerk <br /> <br /> Approve ~0 ~ ~ ~ <br /> Mayor <br /> <br />
