<br /> RESOLUTION N0.6118-87 Brown, Chinnock, Gallagher, <br /> BGYraham, McBride, Salmon, Wendlin <br /> AN EMERGENCY RESOLUTION withdrawing the objection of Council <br /> to the issuance of a new D5 liquor permit to Mark and Julie Shary <br /> d/b/a Players Pizza Pasta for an establishment located at 14523-25 <br /> Madison Avenue in the City of Lakewood, and repealing Resolution No. <br /> 6098-86 adopted November 24, 1986. <br /> WHEREAS, pursuant to Resolution 6098-86 adopted November 24, <br /> 1986, this Council objected to the granting by the Department of <br /> Liquor Control of the State of Ohio of a new D5 liquor permit to Mark <br /> and Julie Shary d/b/a Players Pizza Pasta fox an establishment located <br /> at 14523-25 Madison Avenue, Lakewood, Ohio, and <br /> WHEREAS, said applicants have executed an Agreement with the <br /> City that they will: <br /> 1. Maintain the hours of 4:00 p.m, to 12:00 a.m., Monday <br /> through Saturday; <br /> 2. offer no live entertainment; <br /> 3. encourage alcohol consumption only with food; <br /> 4, not convert the use to a bar only; <br /> 5. notify any purchaser or transferee upon sale or transfer <br /> of this Agreement; and <br /> 6. abide by all of the laws of the State of Ohio and City of <br /> Lakewood, and <br /> WHEREAS, under these circumstances and in consideration <br /> thereof, this Council deems it appropriate to withdraw the objection <br /> to the issuance of a new D5 liquor permit to Mark and Julie Shary <br /> d/b/a Players Pizza Pasta for an establishment located at 14523-25 <br /> Madison Avenue, Lakewood, Ohio; and <br /> WHEREAS, this resolution constitutes an emergency measure <br /> providing for the immediate preservation of the public health, safety <br /> and welfare and for the usual daily operation of a municipal <br /> department; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> Section 1. That in consideration of the Agreement of the <br /> applicants, this Council authorizes and directs the Director of Law to <br /> withdraw Council's objection to the issuance of a new D5 liquor permit <br /> to Mark and Julie Shary d/b/a Players Pizza Pasta for an establishment <br /> located at 14523-25 Madison Avenue, Lakewood, Ohio. <br /> Section 2. That Resolution No. 6098-86 adopted November 24, <br /> 1986, shall be and the same is hereby repealed. <br /> Section 3. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of this <br /> resolution were adopted in an open meeting of this Council, and that <br /> all such deliberations of this Council and of any of its committees <br /> that resulted in such formal action, were in meetings open to the <br /> public in compliance with all legal requirements. <br /> Section 4. That this resolution is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and <br /> provided it receives the affirmative vote of two-thirds of all members <br /> <br />
