RESOLUTION N0.6118-87 Brown, Chinnock, Gallagher, BGYraham, McBride, Salmon, Wendlin AN EMERGENCY RESOLUTION withdrawing the objection of Council to the issuance of a new D5 liquor permit to Mark and Julie Shary d/b/a Players Pizza Pasta for an establishment located at 14523-25 Madison Avenue in the City of Lakewood, and repealing Resolution No. 6098-86 adopted November 24, 1986. WHEREAS, pursuant to Resolution 6098-86 adopted November 24, 1986, this Council objected to the granting by the Department of Liquor Control of the State of Ohio of a new D5 liquor permit to Mark and Julie Shary d/b/a Players Pizza Pasta fox an establishment located at 14523-25 Madison Avenue, Lakewood, Ohio, and WHEREAS, said applicants have executed an Agreement with the City that they will: 1. Maintain the hours of 4:00 p.m, to 12:00 a.m., Monday through Saturday; 2. offer no live entertainment; 3. encourage alcohol consumption only with food; 4, not convert the use to a bar only; 5. notify any purchaser or transferee upon sale or transfer of this Agreement; and 6. abide by all of the laws of the State of Ohio and City of Lakewood, and WHEREAS, under these circumstances and in consideration thereof, this Council deems it appropriate to withdraw the objection to the issuance of a new D5 liquor permit to Mark and Julie Shary d/b/a Players Pizza Pasta for an establishment located at 14523-25 Madison Avenue, Lakewood, Ohio; and WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That in consideration of the Agreement of the applicants, this Council authorizes and directs the Director of Law to withdraw Council's objection to the issuance of a new D5 liquor permit to Mark and Julie Shary d/b/a Players Pizza Pasta for an establishment located at 14523-25 Madison Avenue, Lakewood, Ohio. Section 2. That Resolution No. 6098-86 adopted November 24, 1986, shall be and the same is hereby repealed. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members
