RESOLUTION N0. 67$2-87 BY: Brown Chinnock, GGallagher, Gazzana George, Graham, Wendling AN EMERGENCY RESOLUTION to determining to amend Resolution No. 6130-87, Special Homestead Exemption. WHEREAS, this Council has heretofore on March 16, 1987, adopted Resolution No. 6130-87 authorizing and directing the Director of Public Works to establish water rates for the years beginning March 1, 1987; March 1, 1988; and-March 1, 1989, and to provide for a Special Homestead Exemption, and WHEREAS, certain requirements have been established for consumers seeking a special exemption which includes that the consumer must own and occupy their property which discriminates against renters charged with water bills, and WHEREAS, this Resolution constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 4 of Resolution No. 6130-87 adopted March 16, 1987, now reading as follows: "Section 4. That the Dirctor of Public Works is hereby authorized and directed to establish a Special Homestead Exemption effective March 1, 1987, whereby a minimum service and consumption charge shall be made to homesteads owned by persons 65 years of age or older or by a permanently or totally disabled person provided that such person's total income is less than $15,000 annually. The minimum charge for the first 1,000 cubic feet of water or less used by each homestead during each one or three month billing period shall be Eleven Dollars And Seventy-Three Cents ($11.73) beginning March 1, 1987; Twelve Dollars and Thirty-One Cents ($12.31) beginning on March 1, 1988; and Twelve Dollars and Ninety-Three Cents ($12.93) beginning on March 1, 1989. All water used in excess of 1,000 cubic feet during each one or three month billing period shall cost One Hundred Seventeen and Three Tenths Cents (117.3) per 100 cubic feet beginning March 1, 1987; One Hundred Twenty Three and One Tenth Cents (123.1) per 100 cubic feet beginning on March 1, 1988; and One Hundred Twenty- Nine and Three Tenths Cents (129.3) per 100 cubic feet beginning March 1, 1989." shall be and the same is hereby amended to read as follows: "Section 4. That the Dirctor of Public Works is hereby authorized and directed to establish a Special Homestead Exemption effective March 1, 1987, whereby a minimum service and consumption charge shall be made to homesteads owned by persons 65 years of age or older or by a permanently or totally disabled person provided that such person's total household income is less than $15,000.00 annually. This Special Homestead Exemption shall also be extended to persons so qualified renting and occupying a single family home provided that it can be demonstrated satisfactorily to the Director that such person is paying the water bill directly to the City of Lakewood, and that such qualified person will be the beneficiary of such exemption. 1
