<br /> A RESOLUTION objecting to the transfer of ownership of D2,
<br /> D2X, D3 and D3A liquor permits from Robert Wood, Inc d/b/a Kevin
<br /> McDonoughs Tavern to T E H, Inc. d/b/a McDonoughs fox an establishment
<br /> located at 13319-21 Madison Avenue, Lakewood, Ohio.
<br /> WHEREAS, the City has been advised that an application has
<br /> been filed with the Ohio Department of Liquor Control to transfer the
<br /> ownership of D2, D2X, D3 and D3A liquor permits from Robert Wood, Inc.
<br /> d/b/a Kevin McDonoughs Tavern to T E H, Inc. d/b/a McDonoughs for an
<br /> establishment located at 13319-21 Madison Avenue, Lakewood, Ohio, and
<br /> WHEREAS, although Theresa E. Horwedel, sole shareholder of
<br /> the applicant corporation has failed and/or refused to speak with
<br /> Lakewood Police officers, investigation discloses that her son, Norman
<br /> Horwedel, who is the actual manager of the business being conducted at
<br /> 13319-21 Madison Avenue and who will be the manager of the business of
<br /> the applicant, has been convicted of a crime which relates to his
<br /> fitness to operate a liquor establishment, and
<br /> WHEREAS, investigation further discloses that Norman
<br /> Horwedel has been operating and/or managing the liquor establishment
<br /> of Robert Wood, Inc., the transfexing corporation., in a manner that
<br /> demonstrates a disregard for the laws, regulations, and/or local
<br /> ordinances of the State of Ohio and the City of Lakewood, and
<br /> WHEREAS, this Council determines that the transfer of
<br /> ownership of said liquor permits would be contrary to the best
<br /> interests of the entire community and would place additional burdens
<br /> upon the facilities of the Lakewood Police Department; now, therefore,
<br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE
<br /> OF OHIO:
<br /> Section 1. That this Council hereby strenuously objects to
<br /> the transfer of ownership by the Department of Liquor Control of the
<br /> State of Ohio of the D2, D2X, D3 and D3A liquor permits for the
<br /> premises located at 13319-21 Madison Avenue, Lakewood, Ohio, from
<br /> Robert Wood, Inc. d/b/a Kevin McDonoughs to T E H, Inc. d/b/a
<br /> McDonoughs, for the reasons set forth above all in accordance with the
<br /> provisions of Sections 4383.26 and 43U3.292 of the Revised Code of
<br /> Ohio.
<br /> Section 2. That the Clerk of Council is hereby authorized
<br /> and directed to forward a certified copy of this Resolution together
<br /> with a letter of objection and a letter requesting that the hearing be
<br /> held in Cleveland, Cuyahoga County, Ohio, to the Department of Liquor
<br /> Control, State of Ohio, Permit Division, forthwith.
<br /> Section 3. That this Council designates the Law Department
<br /> of the City of Lakewood to represent it and the City of Lakewood at
<br /> any hearings before the Department of Liquor Control.
<br /> Section 4. It is found and determined that all formal
<br /> actions of this Council concerning and relating to the passage of this
<br /> resolution were adopted in an open meeting of this Council, and that
<br /> all such deliberations of this Council and of any of its committees
<br /> that resulted in such formal action were in meetings open to the
<br /> public in compliance w,i/th all legal requirements.
