RESOLUTION NO. 6257-8$ BY: Brown, Chinnock, Gazzana, George, Graham, Wendling AN EMERGENCY RESOLUTION to permit Mark and Julie Shary d/b/a Players Pizza Pasta for an establishment located at 14523-25 Madison Avenue, in the City of Lakewood, to change hours of operation for the sale of intoxicating liquor to 11:00 a.m. to 12:00 midnight, Monday through Saturday. WHEREAS, pursuant to Resolution 6118-87 adopted January 19, 1987, this Council withdrew its objection to the granting by the Department of Liquor Control of the State of Ohio of a new D5 liquor permit to Mark and Julie Shary d/b/a Players Pizza Pasta for an establishment located at 14523-25 Madison Avenue, Lakewood, Ohio, on certain conditions, and WHEREAS, the permit holders now desire to amend said agreement to expand the hours of operation to include lunchtime, and WHEREAS, the permit holders have applied and been granted a variance by the Board of Zoning Code Appeals for parking between the hours of 11:00 a.m. to 12:00 midnight, Monday through Sunday, and WHEREAS, under the terms herein stated this Council agrees to the amendment of the agreement with the permit holders as to the hours of operation only, with all other conditions to remain in effect; and WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare and for the usual daily operation of a municipal department; now therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Council authorizes Mark and Julie Shary d/b/a Players Pizza Pasta located at 14523-25 Madison Avenue, Lakewood, Ohio, to change the hours of operation for the sale of intoxicating liquor to 11:00 a.m. to 12:00 midnight, Monday through Saturday. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements. Section 3. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earizest period allowed by law.
