<br /> AN EMERGENCY RESOLUTION withdrawing the objection of Council to the
<br /> renewal of D1, D2, D3 and D3A liquor permits issued to Susan Flanagan and
<br /> Kathleen Keating d/b/a Lakewood Village Tavern for an establishment located
<br /> at 13437-41 Madison Avenue, in the City of Lakewood, and repealing
<br /> Resolution No. No. 6178-87 adopted August 25, 1987.
<br /> WHEREAS, pursuant to Resolution 6178-87 adopted August 25, 1987, this
<br /> Council objected to the renewal of D1, D2, D3 and D3A liquor permits issued
<br /> to Susan Flanagan and Kathleen Keating, d/b/a Lakewood Village Tavern for
<br /> an establishment located at 13437-41 Madison Avenue, Lakewood, Ohio, and
<br /> WHEREAS, said permit holders have indicated to the City that they are
<br /> desirous of selling their present liquor establishment, but have been
<br /> unable to do so because of the objection by the City to the renewal of
<br /> their liquor permits, and
<br /> WHEREAS, in consideration of the withdrawal of the objection by the
<br /> City, said permit holders have executed an Agreement with the City that
<br /> they will make every effort to sell the establishment at._ the earliest
<br /> possible date, and
<br /> WHEREAS, under these circumstances and in consideration thereof, this
<br /> Council deems it appropriate to withdraw the objection to the renewal of
<br /> D1, D2, D3 and D3A liquor permits issued to Susan Flanagan and Kathleen
<br /> Keating d/b/a Lakewood Village Tavern for an establishment located at
<br /> 13437-41 Madison Avenue, Lakewood, Ohio; and
<br /> WHEREAS, this resolution constitutes an emergency measure providing
<br /> for the immediate preservation of the-public health, safety and welfare and
<br /> for the usual daily operation of a municipal department; now, therefore,
<br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br /> Section 1. That in consideration of the Agreement of the permit
<br /> holders to sell their liquor establishment, -this Council authorizes and
<br /> directs the Director of Law to withdraw Council's objection to the renewal
<br /> of D1, D2, D3 and D3A liquor permits issued to Susan Flanagan and Kathleen
<br /> Keating d/b/a Lakewood Village Tavern for an establishment located at
<br /> 13437-41 Madison Avenue, Lakewood, Ohio.
<br /> Section 2. That Resolution No. 6178-87 adopted August 25, 1987, shall
<br /> be and the same is hereby repealed.
<br /> Section 3. It is found and determined that all formal actions of this
<br /> Council concerning and relating to the passage of this resolution were
<br /> adopted in an open meeting of this Council, and that all such deliberations
<br /> of this Council and of any of its committees that resulted. in such formal
<br /> action, were in meetings open to the public in compliance with all legal
<br /> requirements.
<br /> Section 4. That this resolution is hereby declared to be an emergency
<br /> measure for the reasons stated in the preamble hereof and provided it
<br /> receives the affirmative vote of two-thirds of all members elected to
<br /> Council, it shall take effect and be in force immediately upon its adoption
<br /> and approval by the Mayor; otherwise, it shall take effect and be in force
<br /> after the earliest period allowed by law.
