REFERRED TO T&S COMMITTEE ON MARCH 6, <br /> 1989 <br />RESOLUTION NO. 6350'89 BY: Brown, Chinnock, Gallagher, George, <br /> Graham, Wendling <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the Mayor, for <br />and on behalf of the City of Lakewood, to enter into an agreement with the <br />Board of Cuyahoga County Commissioners, to participate in the Cuyahoga Major <br />Emergency Incident Management System (CMEIMS). <br /> <br /> WHEREAS, Section 5915.071 of the Ohio Revised Code specifies that <br />the counties and communities shall establish emergency management programs if <br />the counties or communities are not participating in a countywide emergency <br />management agency established pursuant to Section 5915.06 of the Ohio Revised <br />Code or a Regional Emergency Authority established pursuant to Section <br />5915.07 of the Ohio Revised Code; and <br /> <br /> WHEREAS, neither the aforementioned countywide emergency management <br />agency, nor regional emergency management authority has been established in <br />the County of Cuyahoga; and <br /> <br /> WHEREAS, the County, by its Resolution No. 703319, has established <br />the Cuyahoga Emergency Management Advisory Board (CEM Board) to develop and <br />implement an emergency management program in accordance with Section 5915.071 <br />of the Ohio Revised Code; and <br /> <br /> WHEREAS, the CEM Board has developed the CMEIMS, its emergency <br />management program; and <br /> <br /> WHEREAS, the County and City of Lakewood have determined that in <br />the interests of public health, safety and welfare, the CMEIMS should be made <br />available to the county's communities, and that the effectiveness of the <br />CMEIMS will improve with the participation .of the City of Lakewood; and <br /> <br /> WHEREAS, Section 307.15 of the Ohio Revised Code specifies that the <br />City of Lakewood may enter into an agreement with the County to exercise any <br />power, perform any function, or render any service on behalf of a municipal <br />corporation or township; and <br /> <br /> WHEREAS, Section 5915.09 of the Ohio Revised Code provides that <br />private and public agencies may enter into mutual aid arrangements for <br />reciprocal emergency management, aid or assistance; and <br /> <br /> WHEREAS, the City of Lakewood has determined that it wishes to <br />fulfill its responsibilities under Section 5915.071 of the Ohio Revised Code <br />by participating in the CMEIMS pursuant to Section 307.15 of the Ohio Revised <br />Code, and to provide reciprocal emergency management aid and assistance in <br />accordance with Section 5915.09 of the Ohio Revised Code; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be, and he is hereby authorized and <br />directed to enter into an agreement with the Board of County Commissioners, <br />County of Cuyahoaga, Ohio, and the Cuyahoga Emergency Management Advisory <br />Board, in connection with the provisions of emergency management capacity <br />under the Cuyahoga Major Emergency Incident System. <br /> <br /> Section 2. That this Resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of 2/3 of all members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br />Adopted: <br /> <br />~RESI DENT <br /> <br />Approved "- ~x~ ~ ~q~S <br /> <br /> <br />
