Board of Building Standards <br />Public Hearing <br />February 13, 1989 <br /> <br />value of the property was, Hr. Janis stated that from what he <br />understands of the value of the homes on the street, that this <br />home, in good condition would be worth $60,000 to $70,000. When <br />asked what it would cost to bring the property up to code, Hr. <br />Janis stated that Mr. Doubrava had estimated $28,500. <br /> <br />Hr. Forte then asked Hr. Janis when he took on the case? Hr. <br />Janis responded, sometime in 1985. When asked if he had been in <br />the property, Hr. Janis stated no. He felt that as an attorney, <br />it was not appropriate for him to enter the property until the <br />title had changed. Hr. Forte then asked if the property was <br />insured and Hr. Janis responded that he had advised Hs. Koontz to <br />continue keeping insurance. <br /> <br />Hr. Hurman then stated that the Board could go ahead and decide <br />the case based on the evidence presented. Hr. Janis then said, <br />"it is a difficult situation without revealing client confidences <br />or negotiations in progress or anything. I don't know if any . of <br />you gentlemen are lawyers or have any knowledge in the foreclo- <br />sure area, but in trying to resolve this matter either by sale <br />through the sheriff's office or by private sale, obviously the <br />latter type is much more difficult when the seller, 'if it were <br />Hrs. Koontz can't pass title. I hope you can understand the <br />problem she faces being asked to rehabilitate a building where <br />she could do it and Hr. & Hrs. Reed could come back and live <br />there again. Although I don't think that's very likely.' <br /> <br />Hr. Hurman responded, "there is no drafted proposal before the <br />Board from Hrs. Koontz or anybody else to rehabilitate the <br />property. If Hrs. Koontz or some other party came in here and <br />indicated the ability and the interest in rehabilitating the <br />property, that's something you might consider. But Hr. Janis is <br /> <br />not proposing that as I understand it tonight. He's proposing <br />that something like that might happen, but there's no proposal to <br />this Board or to the city that she intends to or by your presence <br />tonight, takes on the responsibility of rehabilitating that <br />property.' <br /> <br />Mr. Janis then said, "I am not authorized to tell the Board <br />tonight that my client is going to spend these sums of money. Hy <br />client has an obligation to protect her investment in this <br />property by attending, through me, the foreclosure sale. And <br />based upon the appraisal that is going to be issued by the Sher- <br />iff's Department, it becomes (for the first time) feasible for my <br />client to bid the property in and buy it at Sheriff's Sale and <br />then make a proposal or sell it to someone who's willing to make <br />a proposal to the Board to rehabilitate the property. Both goals <br />being to rehabilitate. I guess what that says is, that Mr. & <br />Hrs. Reed have a substantial amount of equity in this property <br />and for some reason, unbeknownst to any of us here perhaps, <br /> <br /> <br />
