RESOLUTION NO. 6376-89 BY: Brown, Chinnock, Gallagher Gazzana, George, Graham, Wendlil AN EMERGENCY RESOLUTION' urging our State Legislature to consider a proposed amendment to Revised Code Chapter 3700, the State Certificate of Need law, affecting Lakewood Hospital WHEREAS, Lakewood Hospital is a critical asset of our community serving all of the citizens of Lakewood, and WHEREAS, Lakewood Hospital must have the ability to compete effectively in the health care industry if it is to continue as an important asset of our community, and WHEREAS, Lakewood Hospital must offer a full range of services to be competitive in the entire health care industry, and WHEREAS, flexibility is a necessary part of that competitive ability, and WHEREAS, it is desirable that services such as obstetrics be available in our City both to improve the hospital's effectiveness and for the general welfare of the City of Lakewood and its residents, and WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the health, safety and welfare of the citizens of Lakewood, now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council and the Mayor for and on behalf of the citizens of Lakewood, respectfully urge all members of the Ohio General Assembly and particularly our State Senator Charles Butts and State Representative Madeline Cain to favorably consider enactment of the proposed amendment to the Certificate of Need law which would authorized affiliated hospitals the right to relocate or recatagorize hospital beds consistent with the guidelines in the current Certificate of Need law. Section 2. It is found and determined that the amendment proposed by Lakewood Hospital to the Certificate of Need law of the State of Ohio is essential to the continuation and preservation of Lakewood Hospital as an important community asset and, therefore, that such amendment to the law, which is attached hereeto and incorporated by reference herein, will be of benefit to the health delivery system in the City of Lakewood and throughout the State of Ohio. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law. 1
