RESOLUTION NO. 6436-89 BY: Brown, Chinnock, Gallagher, Gazzana, George, Graham, Wendling AN EMERGENCY RESOLUTION to establish the date for holding the first meeting of Council in 1990 as January 2, 1990, at 7:30 p.m. WHEREAS, Article III, Section 4 of the Amended Charter of the City of Lakewood provides that Council shall meet the first Monday in January following each regular Municipal election for the purpose of electing its officers for the next two years, and WHEREAS, in 1990, the first Monday in January is such a date following a regular Municipal election and falls on a national, state and City holiday, namely New Years Dayw and WHEREAS, such occurrence happens approximately only once every 28 years, and WHEREAS, the only business that is required to be conducted at such meeting is the election of Council officers, and WHEREAS, it is generally provided that when an official date for the taking of such action under law falls upon a declared holiday, the date for such action shall be the next following day, and WHEREAS, this resolution constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council hereby declares that it is in the public interest that the first meeting in 1990 be held on Tuesday, January 2, 1990, at 7:30 p.m. in the City Hall Council Chambers both for the purpose of election of officers and the conducting of ordinary business to come before City Council in accordance with the published adjenda. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 3. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
