RESOLUTION NO. <br /> <br />6437-89 <br /> <br /> BY: Brown, Chinnock, Gallagher, <br />Gazzana, George, Graham, Wendling <br /> <br /> AN EMERGENCY RESOLUTION to establish five miles per hour as <br />the maximum safe speed and maximum speed limit on Clifton Prado. <br /> <br /> WHEREAS, the City Traffic Engineer has determined that <br />Clifton Prado is an alley located within the City of Lakewood, and <br /> <br /> WHEREAS, the City Traffic Engineer, after an engineering <br />and traffic investigation, has determined that five miles per hour is <br />the maximum safe speed for Clifton Prado, and <br /> <br /> WHEREAS, such determination was <br />Revised Code Section 4511.21 and Section <br />Codified Ordinances, and <br /> <br />made pursuant to Ohio <br />333.02 of the Lakewood <br /> <br /> WHEREAS, this emergency resolution is in the best interest <br />of the health, safety and welfare of our citizens; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council determines, based upon the <br />engineering and traffic investigation conducted by the City Traffic <br />Engineer that the maximum safe speed upon Clifton Prado alley is five <br />miles per hour. <br /> <br /> Section 2. That based upon the determined made by the City <br />Traffic Engineer and pursuant to Section 333.03 of the Lakewood <br />Codified Ordinances and Section 4511.21 of the Ohio Revised Code, the <br />maximum speed limit for Clifton Prado is hereby established at five <br />miles per hour and the Director of Public Works is instructed to post <br />signage indicating same forthwith. Such speed limit shall be <br />effective and enforced upon such posting by the Director of Public <br />Works. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, ~ it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />PRES IDEN~ <br /> <br />Approved: <br /> <br />1 <br /> <br /> <br />
