RESOLUTION NO: 6487-90 BY: Boscia, Gallagher, Gazzana, George, Graham, Roth, Smith AN EMERGENCY RESOLUTION declaring it necessary to improve certain streets in the City of Lakewood by removal, where necessary of the existing surface course, by grading and replacement where necessary, of the base and by resurfacing with asphaltic concrete together with necessary appurtenances hereto. WHEREAS, this Resolution is an emergency measure which is necessary for the immediate preservation of the public peace, property, health and safety and for the further reason that the improvements herein provided are immediately necessary to eliminate existing hazards to vehicular traffic using the streets of this City; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE oF OHIO: Section 1. That it is necessary to improve the following streets in the City of Lakewood: ° Eldred Avenue (Hilliard Rd. to Delaware)) ° Garfield Avenue (Brown to Warren Roads) ° Kenneth Drive (N. Terminus to Lake Avenue) ° Lakewood Heights Boulevard (Woodward Ave. to W. Terminus) ° Lauderdale Avenue (Detroit to Madison Aves.) ° Mars Avenue (Hilliard Blvd. to Madison Ave.) ° Northland Avenue (Detroit to Margaret Aves.) ° Northwood Avenue (Granger to W. Clifton) ° Richland Avenue (Madison to Lakewood Hghts Blvd.) o Waterbury Road (Madison Ave. to Franklin Blvd) ° Winton Avenue (Cordova to Madison Aves.) ° Wyandotte Avenue (Detroit to Madison Aves.) Section 2. That said streets shall be improved in accordance with specifications hereinafter referred to and now on file in the office of the City Engineer by removal, where necessary, of the existing surface course, by grading and replacement where necessary, of the base, and by resurfacing with asphaltic concrete including the necessary replacement and resetting of castings together with necessary appurtenances thereto. Section 3. It is hereby determined and declared that said improvement is conducive to the public health, convenience and welfare of said City and the inhabitants thereof. Section 4. That the plans, specifications and estimates of the proposed improvements, heretofore prepared and now on file in the office of the City Engineer, are hereby approved. Section 5. Council hereby determines that the lots and lands abounding and abutting upon the proposed improvements are specially benefited by said improvements. Those lots with frontage so benefited by said improvements shall be assessed at the rate of $7.00 per foot of frontage. Those lots with side yards benefited by any of the said improvements shall be assessed an amount equal to the average for all lots having frontage on the improved portion of the street plus $7.00 per foot for any lot depth in excess of 150-feet. It is estimated that these assessments shall cover approximately fifty percent (50%) of the actual cost of said improvement, to wit: the cost of preliminary and other surveys, plans, specifications, profiles, and estimates and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the preparation, levy, and collection of the special assessments, the cost of purchasing appropriating, and otherwise acquiring labor and material and interest on bonds and notes issued in anticipation of the levy and collection of the special assessment together with all other necessary expenditures. Such amount being hereby determined to be equal to the special benefit derived by lands so abounding and abutting these improvements.
