RESOLUTION NO: 6487-90 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION declaring it necessary to improve certain streets <br />in the City of Lakewood by removal, where necessary of the existing surface <br />course, by grading and replacement where necessary, of the base and by <br />resurfacing with asphaltic concrete together with necessary appurtenances <br />hereto. <br /> <br /> WHEREAS, this Resolution is an emergency measure which is necessary <br />for the immediate preservation of the public peace, property, health and <br />safety and for the further reason that the improvements herein provided are <br />immediately necessary to eliminate existing hazards to vehicular traffic <br />using the streets of this City; now, therefore <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE oF OHIO: <br /> <br /> Section 1. That it is necessary to improve the following streets in <br />the City of Lakewood: <br /> <br />° Eldred Avenue (Hilliard Rd. to Delaware)) <br />° Garfield Avenue (Brown to Warren Roads) <br />° Kenneth Drive (N. Terminus to Lake Avenue) <br />° Lakewood Heights Boulevard (Woodward Ave. to W. Terminus) <br />° Lauderdale Avenue (Detroit to Madison Aves.) <br />° Mars Avenue (Hilliard Blvd. to Madison Ave.) <br />° Northland Avenue (Detroit to Margaret Aves.) <br />° Northwood Avenue (Granger to W. Clifton) <br />° Richland Avenue (Madison to Lakewood Hghts Blvd.) <br />o Waterbury Road (Madison Ave. to Franklin Blvd) <br />° Winton Avenue (Cordova to Madison Aves.) <br />° Wyandotte Avenue (Detroit to Madison Aves.) <br /> <br /> Section 2. That said streets shall be improved in accordance with <br />specifications hereinafter referred to and now on file in the office of the <br />City Engineer by removal, where necessary, of the existing surface course, <br />by grading and replacement where necessary, of the base, and by resurfacing <br />with asphaltic concrete including the necessary replacement and resetting <br />of castings together with necessary appurtenances thereto. <br /> <br /> Section 3. It is hereby determined and declared that said improvement <br />is conducive to the public health, convenience and welfare of said City and <br />the inhabitants thereof. <br /> <br /> Section 4. That the plans, specifications and estimates of the proposed <br />improvements, heretofore prepared and now on file in the office of the City <br />Engineer, are hereby approved. <br /> <br /> Section 5. Council hereby determines that the lots and lands abounding <br />and abutting upon the proposed improvements are specially benefited by said <br />improvements. Those lots with frontage so benefited by said improvements <br />shall be assessed at the rate of $7.00 per foot of frontage. Those lots <br />with side yards benefited by any of the said improvements shall be assessed <br />an amount equal to the average for all lots having frontage on the improved <br />portion of the street plus $7.00 per foot for any lot depth in excess of <br />150-feet. It is estimated that these assessments shall cover approximately <br />fifty percent (50%) of the actual cost of said improvement, to wit: the <br />cost of preliminary and other surveys, plans, specifications, profiles, and <br />estimates and of printing, serving and publishing notices, resolutions and <br />ordinances, the amount of damages resulting from the improvement assessed <br />in favor of any owner of land affected by the improvement and the preparation, <br />levy, and collection of the special assessments, the cost of purchasing <br />appropriating, and otherwise acquiring labor and material and interest on <br />bonds and notes issued in anticipation of the levy and collection of the <br />special assessment together with all other necessary expenditures. Such <br />amount being hereby determined to be equal to the special benefit derived <br />by lands so abounding and abutting these improvements. <br /> <br /> <br />
