RESOLUTION NO. 6517-90 <br /> <br />BY: Boscia, Gazzana, Graham, <br /> Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION urging the Department of Housing and <br />Urban Development of the United States Government to review procedures <br />concerning foreclosures on property by HUD to expedite such <br />foreclosures and minimize negative impacts on communities. <br /> <br /> WHEREAS, the Federal Department of Housing and Urban <br />Development is from time to time forced to foreclose on or take <br />possession of residential properties in various programs it supports, <br />and <br /> <br /> WHEREAS, it is in the interest of the Federal Government and <br />local communities that such houses be preserved, maintained, and <br />resold as quickly as possible to preserve the individual housing stock <br />and the community interest, and <br /> <br /> WHEREAS, there have been instances in the City of Lakewood, <br />including the property located at 1361 Geil Avenue, wherein the <br />foreclosure of the property and/or retaking by HUD and return of the <br />property to the housing market in satisfactory condition have taken <br />unreasonably excessive period of time, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure <br />providing for the health, safety and welfare of all citizens of our <br />community; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Federal Department of Housing and Urban <br />Development is urged to immediately review all procedures relative to <br />foreclosure of properties and the maintenance, care of, restoration <br />and resale of such properties to ensure that all procedures therefore <br />are expedited to minimize the negative impact upon the local community <br />in which such properties are located. <br /> <br /> Section 2. That this Council urges the Department of <br />Housing and Urban Development and all elected representatives to take <br />every effort possible to ensure that foreclosed properties do not <br />become a blight on local communities but rather that the Department <br />works in conjunction with local communities, particularly the Building <br />Department in each municipality to ensure that the property is <br />maintained, restored and returned to the mar~ketplace as quickly as <br />possible. <br /> <br /> Section 3. That the Clerk of Council be and she is hereby <br />authorized and directed to forward a certified copy of this resolution <br />to the Director of Housing and Urban Development in Washington, D..C. <br />and to Senators Howard Metzenbaum and John Glenn and United States <br />Representatives Edward Feighan and Mary Rose Oakar, and that a copy of <br />this resolution be spread upon the minutes of this meeting. <br /> <br /> Section 4. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 5. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br /> <br />1 <br /> <br /> <br />
