RESOLUTION NO. <br /> <br />6548-91 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the Mayor of the City <br />of Lakewood to accept the proposed Waste Management Plan and accept fees <br />proposed by the Cuyahoga County Planning Commission as set forth in the County <br />Planning Commission's Resolution No. 901211-A and sign any and all documents <br />and execute any agreements, and <br /> <br /> WHEREAS, the State of Ohio, through the enactment of H.B. 592 has required <br />local communities and the counties to be subject to certain solid waste <br />management guidelines, and <br /> <br /> WHEREAS, the City of Lakewood has a significant interest in the control <br />and disposal of solid waste, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare, <br />and for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. The City of Lakewood accepts the proposed assessments and <br />fees as set forth in the Cuyahoga County Planning Commission's Resolution <br />No. 901211-A. <br /> <br /> Section 2. That the Mayor is hereby authorized, empowered and directed <br />to sign any and all documents necessary relating to Cuyahoga County Planning <br />Commission Resolution No. 901211-A. <br /> <br />Adopted: <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this resolution were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council and of any of its committees that resulted in such formal action <br />were in meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br />Approved: ~~<~,,2 <br /> <br /> <br />
