RESOLUTION NO. 6563-91 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION declaring the necessity and intent <br />of the City of Lakewood to appropriate the real property located at <br />1434 Victoria Avenue in the City of Lakewood, County of Cuyahoga and <br />State of Ohio, owned by Edward Canant and bearing Permanent Parcel No. <br />314-01-103. <br /> <br /> WHEREAS, it has been determined that the subject property is <br />necessary for a public purpose, namely a public roadway for the <br />benefit of the entire community and particulary, the redevelopment of <br />the downtown commercial area, and <br /> <br /> WHEREAS, after extensive negotiations between the City and <br />the property owner, the parties have been unable to agree on a <br />purchase price for the subject property, and <br /> <br /> WHEREAS, the City has been certified by the Department of <br />Economic and Community Development of the State of Ohio as an impacted <br />City, and <br /> <br /> WHEREAS, the subject property , hereinafter more fully <br />described, is needed to create and/or preserve jobs, employment <br />opportunities and to improve the economic welfare of the people of <br />this City for the use or development of the subject property for a <br />public purpose, namely a public roadway now, therefore, <br /> <br /> WHEREAS, this resolution constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby determines it necessary <br />and declares it to be the intention of this Council to appropriate the <br />fee simple interest to the premises hereinafter described for the <br />purpose of using the same to create or preserve jobs, employment <br />opportunities and to improve the economic welfare of the people of the <br />City for the use or development of the subject property for a public <br />purpose, namely a public roadway or such other industrial, commercial, <br />housing, distribution or research use and to prevent the spread of <br />blight, deteriorated or deteriorating conditions, said premises being <br />owned by Edward Canant bearing Permanent Parcel No. 314-01-103 and <br />more fully described in Exhibit "A" attached hereto and incorporated <br />by reference herein. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby <br />authorized and directed to cause written notice thereof to be given to <br />the owner of, person in possession of, or any person having an <br />interest of record therein, or to their authorized agent, and said <br />notice shall be served by a person designated for that purpose by <br />said Clerk of Council and returned made in the manner provided by law <br />for the service and return of summons in civil actions. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />publJc in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br /> <br /> <br />
