RESOLUTION NO. 6594 - 91 <br /> <br /> BY: Boscia, Gallagher, <br />Gazzana, Graham, Roth, Smith <br /> <br /> A RESOLUTION opposing proposed Ohio House Bill 186 <br />substantially changing Ohio's current building code system. <br /> <br /> WHEREAS, this proposed bill would add a surcharge of <br />tax dollars for all permits and certificates and would create an <br />undue burden and hardship for the residents of this City; and <br /> <br /> WHEREAS, this bill would make all three family <br />construction and remodeling part of the Ohio Basic Building Code <br />which would make the requirements so stringent that certain <br />remodeling could not be constructed adding an undue burden to the <br />residents of the City of Lakewood; and <br /> <br /> WHREREAS, adopting a model code for new construction <br />and remodeling would create undue hardship for the residents of <br />the City of Lakewood, which has been totally developed for many <br />years; and <br /> <br /> WHEREAS, the City believes that this bill is another <br />attempt by the State to supersede local building codes and <br />ordinances and further erode the City's "home rule"; and <br /> <br /> WHEREAS, the bill allows the Board of Building <br />Standards to certify a local building department as qualified to <br />enforce the residential or the non-residential building code <br />which in turn would require additional continuing education and <br />would add exorbitant costs to the City budget; and <br /> <br /> WHEREAS, the adoption of this bill may be beneficial to <br />the undeveloped cities, this bill would be detrimental to the <br />City of Lakewood; now, therefore <br /> <br />BE IS RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council and the Mayor, hereby <br />strenuously object to proposed Ohio House Bill 186 which would <br />substantially change Ohio's current building code system for the <br />reasons set forth above. <br /> <br /> Section 2. That the Clerk of Council be and she is <br />hereby authorized and directed to forward certified copies of <br />this Resolution to Representative Madeline Cain and Senator <br />Anthony Sinagra and that a copy of this Resolution be spread upon <br />the minutes of the meeting. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br /> <br />
