RESOLUTION NO. 6610-91 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the Director <br />of Public Works to enter into a contract with Baker Vehicle Systems <br />fOr the purchase of twelve (12) 3-Wheel Refuse Collection Vehicles, <br />without competitive bidding. <br /> <br /> WHEREAS, pursuant to the adoption and approval of Resolution 6492- <br />90 and Ordinance 28-91, funds were appropriated and authorization <br />approved for the purchase of 12 of these vehicles for the Division <br />of Refuse, and, <br /> <br /> WHEREAS, said vehicles are only available from one source, and <br />consequently the formal advertising for bids is impractical, and, <br /> <br /> WHEREAS, Section 111.04(a) (10) provides that contracts under <br />circumstances where Council determines that it is impractical to award <br />the contract under competitive bidding procedure may be awarded without <br />competitive bidding, and, <br /> <br /> WHEREAS, Baker Vehicle Systems has assured us that the price will <br />be $11,913.00 for each vehicle, (the same as the 1991 bid price), it <br />is hereby determined to be in the best interest of the City to purchase <br />these vehicles in this manner, and, <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure in that <br />the immediate purchase of these vehicles will aid in the collection <br />of refuse in a timely manner, and provides for the usual daily operation <br />of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. It is 'hereby determined that 3-Wheel Refuse Collection <br />Vehicles are non-competitive and cannot be secured from any other source <br />other than Baker Vehicle Systems, 8929 Freeway Drive, Macedonia, Ohio, <br />44056, therefore, the Director of Public Works is hereby authorized <br />and directed to enter into a written contract with Baker Vehicle Systems <br />for the purchase of 12, 3-wheel refuse collection vehicles for the <br />sum of approximately $142,956.00. <br /> <br /> Section 2. That the cost of these vehicles shall be paid from <br />the 1991 Capital Improvement Fund. ~ <br /> <br /> Section 3. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this <br />Resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal actiQn were in meetings open to the public <br />in compliance with all legal requirements. <br /> <br /> <br />
