RESOLUTION NO. 6670-91 <br /> <br />BY: Gallagher, Gazzana, George, <br /> Graham, Roth, Smith <br /> <br /> A RESOLUTION authorizing and directing the Director of <br />Public 'Safety to enter into a contract with US West Public Safety <br />Group for the purchase of additional software for the existing Mobile <br />Data Terminals (MDT's) without competitive bidding. <br /> <br /> WHEREAS, pursuant to the adoption and approval of Ordinance <br />No. 28-91, funds were appropriated and authorization approved for the <br />purchase of this additional software equipment to allow the MDT's to <br />become totally operational, and to interface with the present Computer <br />Aided Dispatch (CAD) System; and <br /> <br />and, <br />and, <br /> <br /> WHEREAS, said <br />consequently, the <br /> <br />software is only available from one source <br />formal advertising for bids is impractical; <br /> <br /> WHEREAS, Section lll.04(a) (10) provides .that contracts <br />under circumstances where Council determines that it is impractical to <br />award the contract under competitive bidding procedures may be awarded <br />without competitive bidding; and <br /> <br /> WHEREAS, a ~proposal has been received from US West Public <br />Safety Group to provide additional software for the existing MDT <br />system, which proposal is hereby determined to be reasonable and in <br />the best interest of the City to accept such proposal; and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure in <br />that the acquisition of this additional software is necessary for the <br />MDT system to become totally operational, and to interface with the <br />CAD system at the earliest possible time, and it provides for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. It is hereby determined that additional software <br />for the MDT system cannot be secured from any other source other than <br />US West Public Safety Group, 555 Republic Drive, Plano, Texas 75074; <br />therefore, the Director of Public Safety is hereby authorized and <br />directed to enter into a written contract with US West Public Safety <br />Group on the basis of its proposal dated November 25, 1991, in the sum <br />of approximately $47,000, a copy of said proposal being attached <br />hereto as Exhibit "A" and made a part hereof as if fully rewritten <br />herein. <br /> <br /> Section 2. That the cost of such software shall be paid <br />from the Capital Improvement Fund. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected .to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the~se, it shall take <br />effect and be in force after the earl~er~ al~ed by law. <br /> <br />Adopted: ~o~j <br /> <br /> Cler <br /> <br />Approved:/~r_~ ~ ~ / f 7// <br /> Mayor <br /> <br /> <br />
