RESOLUTION NO. 6674-91 BY: <br /> <br />Gallagher, Gazzana, .Geo: <br />Graham, Roth,~ Smith <br /> <br /> AN EMERGENCY RESOLUTION declaring the necessity and intent <br />of the City of Lakewood to appropriate the real property located at <br />15007 Detroit Avenue in the-City of Lakewood, County of Cuyahoga and <br />State of Ohio, leased by.Irene Oreskovic and bearing Permanent Parcel <br />No. 314-01-108 <br /> <br /> WHEREAS, it has been determined that the subject property <br />is necessary, for a public.purpose, namely the redevelopment of the <br />downtown commerCial area and construction of a public road and right- <br />of-way:, and <br /> <br /> WHEREAs, after extensive negotiations between the CitY and <br />the leaseholder., the parties have been unable to agree on a value for <br />the leasehold interest for the subject property, and <br /> <br /> WHEREAS, .the City has been certified by the Department of <br />Economic and Community Development of the State of Ohio as an impact- <br />ed City, and - <br /> <br /> WHEREAS', .the subject property , hereinafter more 'fully <br />described,' is needed to create and/or preserve jobs, employment <br />opportunities and to improve the economic welfare of the people of <br />this City for the use or development of the subject property for a <br />public purpose, namely the acquisition and consolidation of property <br />necessary-for the Lakewood City Center Project and construction of a <br />public road and right-of-way, now, therefore, <br /> <br /> · WHEREAS, this resolution'constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily, operation .of a municipal depart- <br />ment; now, therefore, <br /> <br />BE 'IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> SectiOn 1. ~That this Council hereby determines it neces- <br />sary and declares it to 'be the intention of this Council to appropri- <br />ate the leasehold interest to the premises hereinafter described for <br />the purpose of using~the same'.to create or preserve jobs-, employment <br />opportunities and to improve the economic welfare'of the people of <br />the City for the use or development of the subject property for a <br />public purpose, namely the acquisition and consolidation of property <br />necessary for the Lakewood City Center Project and construction of a <br />public road and right-of-way or such other industrial, commercial, <br />housing, distribution or research use and to prevent the spread of <br />blight, deteriorated or deteriorating conditions, said premises being <br />leased by Irene Oreskovic bearing Permanent Parcel No. 314-01-108 and <br />more fully described in Exhibit "A" attached hereto and incorporated <br />by reference herein. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby <br />authorized and directed to cause written notice thereof to be.given <br />to the owner of, person in possession of, or any person having an <br />interest of record therein, or to their authorized agent, and said <br />notice shall be served by a person designated for that purpose by <br />said Clerk of Council and returned made in the manner provided by <br />law'for the service and return of summons in civil actions. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this resolution were adopted, in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its commit- <br />tees that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> <br />
