RESOLUTION NO. <br /> <br />6706-92 <br /> <br />BY: Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> A RESOLUTION in support of Senate Bill 252 sponsored <br />by Senator Jeffrey Johnson and House Bill 647 sponsored by <br />Representative Madeline Cain establishing a statutory definition <br />for sexual harassment and specifically prohibiting discriminatory <br />employment practices on the basis of sexual harassment. <br /> <br /> WHEREAS, S.B. 252 and H.B. 647 ~iRe sexual harassment <br />~o'~.~mean any unwelcome sexual advance, request for sexual favor, or <br />other verbal or physical conduct of a sexual nature when any of <br />the following apply: <br /> <br />(a) Submission to the conduct is made either explicitly <br />or implicitly a term or condition of an individual's <br />employment; <br /> <br />(b) Submission to or rejection of the conduct by an <br />individual is used as the basis for an employment <br />decision affecting the individual; <br /> <br />(c) The conduct has the purpose or effect of <br />unreasonably interfering with an individual's work <br />performance 'or creating an intimidating, hostile, or <br />offensive working environment, and <br /> <br /> WHEREAS, S.B. 252 and H.B. 647 extend the statute of <br />limitations for filing an unlawful discriminatory practice <br />complaint with the Ohio Civil Rights Commission from 180 days to <br />two years, and <br /> <br /> WHEREAS, the bills remove the cap on the amoun= of <br />damages victims of sexual harassmen= can claim, and <br /> <br /> WHEREAS, S.B. 252 and H.B. 647 require all businesses <br />with more than four employees to adopt and post a written sexual <br />harassment policy, including a "no retaliation" provision, and <br /> <br /> WHEREAS, the bills allow the state to withhold business <br />and funding from companies that have a history of sexual <br />harassment, and <br /> <br /> WHEREAS, <br />of protecting the <br />now, therefore, <br /> <br />the City of Lakewood recognizes the importance <br />rights of working men and women in our city; <br /> <br />s BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That this Council supports Senate Bill 252 <br />and House Bill 647 which would strengthen laws against sexual <br />harassment, give victims more time to report the crime, place <br />additional requirements on businesses to prevent sexual <br />harassment, and remove the cap on the amount of damages a victim <br />can claim. <br /> <br /> Section 2. That the Clerk of Council be and she is <br />hereby authorized and directed to forward a certified copy of this <br />Resolution to State Senators Jeffrey D.
