NO. 6707-92 <br /> <br /> BY: Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ~I,O,~~ authorizing the creation of the <br />Enforcement and Education Fund and Indigent Drivers Alcohol Treatment <br />Fund within the financial records of the City of Lakewood. <br /> <br /> WHEREAS, Ohio Revised Code Section 4511~99(A) and Lakewood <br />Codified Ordinances Section 333.01 mandate the creation of an En- <br />forcement and Education Fund and Indigent Drivers Alcohol Treatment <br />Fund by the City of Lakewood, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immedia~e""~'~reS'e~ation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal depart- <br />ment in that there are deposits already in the fund and their status <br />must be confirmed; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby authorizes the crea- <br />tion of the following funds for deposits and expenditures, as mandat- <br />ed by Section 4511.99(A) of the Ohio Revised Code and Section 333.01 <br />of the Lakewood Codified Ordinances: <br /> <br />a) <br />b) <br /> <br />Enforcement and Education Fund; and <br />Indigent Drivers Alcohol Treatment Fund. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this resolution were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its commit- <br />tees that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 3. That this resolution is hereby declared to be <br />an emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its'adoption and approval by the Mayor; otherwise, <br />it shall take effect and be in force after the earliest period al- <br />lowed by law. <br />Adopted: ~ /~/ /~q~ ~ <br /> <br />Approved <br /> <br /> <br />
