RESOLUTION NO. 6847-93 AMENDED BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith A RESOLUTION recommending that the City enter into a contract in an amount not to exceed $117,874 for the construction of Park Row Park. 'WHEREAS, pursuant to Ordinance No. 6-93, sealed bids were received by the City of Lakewood for the construction of Park Row Park, and WHEREAS, six bids were submitted ranging from $142,361 to $101,800, all for less than the engineer's estimate of $170,000, and WHEREAS, the Procurement Officer recommended and the Board of Control approved the bid of Surface Engineering in the amount of $101,800 as the lowest and best bid; and WHEREAS, it has come to the attention of the City administration that Surface Engineering may not enter into the contract due to financial difficulties which will cause forfeiture of its Bond and would make S.W. Franks Construction Company the next lowest bidder at $117,874; now therefore ~ BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That Council approves the actions of the Board of Control and recommends that the Director of · Public Works enter into a contract with Surf~e Engineering in the amount of $101,800 for the construction of Park Row Park. Section 2. In the event that Surface Engineering fails to enter into the contract Council approves actions by the Board of Control and Director of Public Works to cause forfeiture of the Bond of Surface Engineering and enter into a contract with S. W. Franks Construction Company in an amount not to exceed $117,874.00 Approved: SeCtion 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and any of its committees such formal action, were in meetin~ in compliance with all legal requi~.
