RESOLUTION NO. 6858-93 By: B0saia, Gallagher, George, <br /> Gibbon, Roth, Seelie, Smith <br />A RESOLUTION recommending that the City enter into a <br />contract in an amount not to exceed $423,830 for the <br />construction of disinfection improvements to the <br />Wastewater Treatment Plant using ultraviolet technology. <br /> <br /> WHEREAS, pursuant to Ordinance No. 6-93, sealed bids <br />were received by the City of Lakewood for the construction <br />of ultraviolet disinfection improvements, and <br /> <br /> WHEREAS, four bids were submitted ranging from <br />$421,000 to $534,893, all for less than the engineer's <br />estimate of $600,000, and <br /> <br /> WHEREAS, North Bay Construction Company Submitted the <br />lowest and best bid of $421,000 and ABC Piping submitted <br />the next lowest and best bid of $423,830.00, and <br /> <br /> WHEREAS, it has come to the attention of the City <br />administration that North Bay Construction Company may not <br />be able to meet the minority business requirements <br />specified by the Ohio Environmental Protection Agency and <br />has been given 15 days to meet the Ohio Environmental <br />Protection Agency's requirements. If North Bay <br />Construction is not able to meet these requirements their <br />bid will not be responsive. ABC Piping Company submitted <br />the next lowest bid, and <br /> <br /> WHEREAS, the Procurement Officer recommended and the <br />Board of Control approved the bid of North Bay <br />Construction Company in the amount of $421,100 as the <br />lowest and best bid if they can meet the minority business <br />requirements specified by the Ohio Environmental <br />Protection Agency within the time requirements of the bid <br />specifications and the Environmental Protection Agency, <br />and if they do not meet said requirements the bid of ABC <br />Piping Company in the amount of $423,830; now therefore <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That Council approves the actions of the <br />Board of Control and recommends that the Director of <br />Public Works enter into a contract with North Bay <br />Construction Company in the amount of $421,100 for the <br />construction of ultraviolet disinfection improvements to <br />the Wastewater Treatment Plant. <br /> <br /> Section 2. In the event that North Bay Construction <br />fails to resolve minority business requirements to the <br />Ohio Environmental Agency's satisfaction, Council approves <br />actions by the Board of Control and Director of Public <br />Works to enter into a contract with ABC Piping Company in <br />an amount not to exceed $423,830.00. <br /> <br /> Section 3.
