Resolution No. 6867-93 <br /> <br />By: <br /> <br />Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> A RESOLUTION in support of House Resolution 140 Federal <br />Mandate Relief Act of 1993. <br /> <br /> WHEREAS, unfunded federal mandates, on state and local <br />governments have become increasingly extensive in recent years, <br />and <br /> <br /> WHEREAS, such mandates have, in many instances, added to <br />growing deficits in state and local budgets and have resulted in <br />the need for local governments to increase revenue or curtail <br />services; and <br /> <br /> WHEREAS, such excessive fiscal burdens on local governments <br />have undermined, in many instances, the ability of local <br />governments to achieve their responsibilities under state and <br />local law, and <br /> <br /> WHEREAS, H.R. 140, the Federal Mandate Relief Act of 1993, <br />would assure that the federal government pays the total amount of <br />direct cost incurred by state and local governments in complying <br />with certain requirements which take effect on or after the date <br />of enactment of the Act under a federal statute or regulation, <br />and <br /> <br /> WHEREAS, this legislation would provide that any requirement <br />under a federal statute or regulation that a state or local <br />government conduct an activity (including a requirement that a <br />government meet national standards in providing a service) shall <br />apply to the government only if all funds necessary to pay the <br />direct costs incurred by the government in conducting the <br />activity are provided by the federal government; now, therefore, <br /> <br /> BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Council of the City' of Lakewood <br />supports H.R. 140 and goes on record as endorsing this. bill. <br /> <br /> Section 2. That the Clerk of Council be and is hereby <br />instructed to forward copies of this resolution to Senator John <br />Glenn, Senator Howard Metzenbaum, Representatives Martin Hoke, <br />Louis Stokes, Sherrod Brown, Thomas Sawyer, Ralph Regula, James <br />Traficant, Jr., Eric Fingerhut; State Senator Anthony Sinagra, <br />House Speaker Vernal Riffe, Jr., and Representative Patrick <br />Sweeney, and Representative Madeline Cain.. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this resolution were adopted in an open meeting of this Council, <br />and that all' such ~deliberations of this Council and any of its <br />committees that resulted in such forma~,~ meetings <br />open to the public, in compliancewi~ lents. <br />Adopted: i~ ~//~ Prat <br /> <br /> Clerk <br />yor <br /> <br /> <br />
