<br /> A RESOLUTION objecting to the transfer of ownership of'
<br />D2, D2X, D3 and D6 liquor permits from Ludwig Trnkus EST., David
<br />TrnkUs ADMR WWA, 12529 Plover St., Lakewood, Ohio, 44107, to Arsic
<br />Petrovic, Inc. d/b/a Paradise Gardens, 12529 Plover St., Lakewood,
<br />Ohio, 44107.

<br /> WHEREAS, the City has been advised that an application
<br />has been filed with the Ohio Department of Liquor Control to
<br />transfer the ownership of D2, D2X, D3, and D6 liquor permits from
<br />Ludwig Trnkus, EST, David Trnkus ADMR WWA, for an establishment
<br />located at 12529 Plover St., Lakewood, Ohio, and
<br /> WHEREAS, investigation reveals that the property is not zoned
<br />for any commercial or industrial use; that it is zoned strictly
<br />residential use, therefore pursuant to ORC Section 4303.26 it
<br />would be appropriate for Council to object to any permit transfer
<br />at these premises, and
<br /> WHEREAS, this Council determines that the transfer of
<br />ownership of said liquor permits would be contrary to the best
<br />interests of the entire community and would place additional
<br />burdens upon the facilities of the Lakewood Police Department;
<br />now, therefore,

<br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD,
<br /> STATE OF OHIO:
<br />
<br /> Section 1. That this Council hereby strenuously objects
<br /> to the transfer of ownership by the Department of Liquor Control
<br /> of the State of Ohio of the D2, D2X, D3 and D6 liquor permits for
<br /> the premises located at 12529 Plover St. Lakewood, ohio, from
<br /> Ludwig Trnkus, EST., David Trnkus ADMR WWA, for the reasons set
<br /> forth above all in accordance with the provisions of Sections
<br /> 4303.26 of the Revised Code of Ohio.
<br />
<br /> Section 2. That the Clerk of ~Council is hereby
<br /> authorized and directed to forward a certified copy of this
<br /> Resolution together with a letter of objection and a letter
<br /> requesting that the hearing be held in Cleveland, Cuyahoga County,
<br /> Ohio, to the Department of Liquor Control, State of Ohio, Permit
<br /> Division, forthwith.
<br />
<br /> Section 3. That this Council designates the Law
<br /> Department of the City of Lakewood to represent it and the City of
<br /> Lakewood at any hearings before the Department of Liquor Control.
