RESOLUTION NO. <br /> <br />6963-94 <br /> <br />BY: Boscia, Flannery, George, <br /> Gibbons, Roth, Seelie, Smith <br /> <br /> A RESOLUTION in support of House Bill 273 sponsored <br />by State Representative Madeline Cain, which makes sexual <br />harassment a violation of the Ohio Civil Rights Law. <br /> <br /> WHEREAS, the legislation creates a uniform sexual <br />harassment and "no retaliation policy", and <br /> <br /> WHEREAS, it requires all public and private employers <br />to adopt, post and provide to each employee, a written sexual <br />harassment policy that includes a "no retaliation" provision and <br />places restriction on businesses that fail to comply, and <br /> <br /> WHEREAS,. H.B. 273 permits the Ohio Civil Rights <br />Commission to award compensatory damages for violation of the <br />Sexual Harassment law created by the legislation and permits a <br />Court in an independent action to award compensatory and <br />punitive damages in such cases, and <br /> <br /> WHEREAS, the bill prohibits the Ohio Civil Rights <br />Commission or the Court from admitting or considering evidence <br />of specific instances of the complainant's or respondent's <br />sexual activity, and <br /> <br /> WHEREAS, there is no sexual harassment provision in <br />current law, whereby present cases are heard under the general <br />sex discrimination provisions of state law, and <br /> <br /> WHEREAS, the legislation creates a provision to <br />prohibit any state agency or political subdivision from <br />distributing funds to any employer/business that fails to comply <br />with the model sexual harassment and retaliation policy, and <br /> <br /> WHEREAS, the employer/business must show proof of <br />compliance prior to any relationship with the particular public <br />entity; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. That this Council supports House Bill 273 <br />which would strengthen laws against sexual harassment, give <br />victims more. time to report the crime, place additional <br />requirements on businesses to prevent sexual harassment, and <br />provides for a no retaliation clause. <br /> <br /> Section 2. That the Clerk of Council be and she is <br />hereby authorized and directed to forward a certified copy of <br />this Resolution to the Clerk of the Ohio Senate, c/o State <br />House, Columbus, Ohio, 43266-0603 and that a copy of this <br />Resolution be spread upon the minutes of the meeting. <br /> <br /> <br />
