RESOLUTION NO. 6966-94 BY: Boscia, Flannery, George, <br /> <br /> Gibbons, Roth, Seelie, <br /> Smith <br />A RESOLUTION declaring the intent of the Council of the City <br />of Lakewood to vacate a portion of Victoria Avenue upon the <br />condition that the owners of property abutting thereon convey to <br />the City easements for the maintenance of a public sidewalk and <br />various public utilities. <br /> <br /> WHEREAS, the City desires to vacate a portion of Victoria <br />Avenue to accommodate the optimum design of a parking lot to be <br />constructed by the City on adjacent property; and <br /> <br /> WHEREAS, the City desires to retain an easement over the <br />vacated portion of Victoria Avenue for purposes of maintaining a <br />public sidewalk and various public utilities; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> SECTION 1. That the Council of the City of Lakewood <br />hereby declares its intent to vacate a portion of Victoria Avenue <br />more fully described in attached Exhibit A. <br /> <br /> SECTION 2. That said vacation is conditioned upon the <br />conveyance by owners of property abutting thereon easements to <br />the City for the purpose of maintaining a public sidewalk and <br />various utilities, public and private. <br /> <br /> SECTION 3. That the Clerk of Council be and she is <br />hereby authorized and directed to cause notice of such <br />declaration to be served in the manner that the service of <br />summons is required to be made, upon all persons whose property <br />abuts the portion of Victoria Avenue affected by the proposed <br />vacation, and by publication once in one newspaper of general <br />circulation~in the City of Lakewood as to all persons who cannot <br />be personally served. Said notice shall state the time and place <br />when objections can be heard before the Board of Revision of <br />Assessments. <br /> <br /> SECTION 4. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this resolution were adopted in an open meeting of this Council, <br />and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br />Approved.~~ 7, / ~ 7 ~ <br /> <br />President <br /> <br />May~r < <br /> <br />1 <br /> <br /> <br />
