EXHIBIT A. <br /> <br />FUNDING AGREEMENT <br /> <br />This Agreement entered into as of this day of , 19 , by <br />and between the Board of County Commissioners, Cuyahoga County, Ohio, <br />(hereinafter referred to as "County" and the City of Lakewood, Ohio, (hereinafter <br />referred to as "City). <br /> <br />WITNESSETH THAT: <br /> <br />WHEREAS, pursuant to Stewart B. McKinney Homeless Assistance Act, Lakewood has <br />applied for and received a grant from the Emergency Shelter Grant Program (ESGP) <br />for certain assistance to homeless activities; and <br /> <br />WHEREAS, the City desires that the County administer the ESGP on its behalf; and <br /> <br />WHEREAS, it is necessary that the County and the City enter into an Agreement for <br />the implementation of the ESGP; <br /> <br />NOW, THEREFORE, the parties do hereby agree as follows: <br /> <br />5e <br /> <br />Scope of Service. The County hereby agrees to utilize funds made available <br />under the ESGP for the purpose of implementing the above mentioned activity <br />as described in Attachment I -- Work Program, which is attached hereto and <br />made a part hereof as if fully rewritten. Changes in Attachment I -- Work <br />Program may be requested from time to time by either the County or City <br />Subdivision and shall be incorporated in written amendments to this <br />Agreement. The County certifies that the funds to be provided by the City <br />will be used solely for eligible activities under the ESGP. <br /> <br />Time of Performance. This Agreement shall take effect as of April 1, 1995 <br />through to and including March 31, 1997. <br /> <br />Compensation. The City shall compensate the County for all expenditures <br />made in accordance with this Agreement. Compensation shall be provided <br />during the term of this Agreement not to exceed $85,000.00. In no event <br />are payments to be financed by funds other than the funds granted by the <br />Federal Government for the ESGP. <br /> <br />Method of Payment. The City shall reimburse the County or advance funds to <br />the County based on a statement of expense or estimated expenses which <br />shall be submitted to the City by the fifteenth day of each month for the <br />proceeding month. Payment shall be made within thirty (30) days of receipt <br />by the City or a statement of expenses, providing that funds for the <br />project have been deposited with the City. <br /> <br />Proqram Income. Ail income received from ESGP funded activities shall be <br />considered program income and subject to Attachment E -- OMB Circular A~102. <br />Ail pro~ram income earned from ESGP funded activities shall be returned to <br />the City within a sixty (60) day time period. <br /> <br />In addition, the following requirements will appl~: <br /> <br />ao <br /> <br />The County must inform the City of any income generated by the <br />expenditure of ESGP funds received by the County; and <br /> <br />Any such program income must be paid to the City or the County may <br />retain the program income subject to requirements set forth in the <br />Agreement; and <br /> <br />Any program income the County is authorized to retain may only be <br />used for eligible activities in accordance with all ESGP 'requirements <br />as may then apply; and <br /> <br />Do <br /> <br />The City has the responsibility for monitoring and reporting to HUD <br />on the use of any such program income thereby requiring appropriate <br />record keeping and reporting by the County as may be needed for this <br />.purpose; and <br /> <br />In the event of close-out or change in status of the County any <br />program income that is on hand or received subsequent to the <br />close-out or change in status shall be paid to the City. <br /> <br /> <br />
