RESOLUTION NO.: 7032-95 <br /> <br />BY: <br /> <br />Boscia, Flannery, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> A RESOLUTION in support of the City of Garfield Heights' <br />Ordinance to reduce the electric rates provided by Cleveland <br />Electric Illuminating Company (CEI). <br /> <br /> WHEREAS, on May 9, 1994, the City Council of Garfield <br />Heights passed an ordinance to enact a thirty percent (30%) <br />reduction in the electric rate for all Garfield customers; and, <br /> <br /> WHEREAS, as of July 1, 1993, CEI and the highest <br />residential electric rates in Ohio for the average residential <br />customer using 500kwh per month. The CEI rates were $67.52 for <br />that service. The average for the five (5) major Ohio electric <br />utilities, was $45.50;~ and <br /> <br /> WHEREAS, CEI's electric rates for the average <br />resideDtial customer using 500 kwh per months have increased two <br />hundred thirty-six percent (236%) from 1976 ($20.08) to 1993 <br />($67.52); compared to an average increase of one hundred <br />forty-eight percent (148%) for all of the other five major Ohio <br />electric utility companies; and <br /> <br /> WHEREAS, the Ohio Revised Code and Sections 3, 4 and 7 <br />of Article XVIII of the Ohio Constitution confers upon <br />municipalities the authority to set rates; and <br /> <br /> WHEREAS, the City. of Lakewood supports the City of <br />Garfield Heights' exercise of its authority to fix rates, terms <br />and conditions of electrical service pursuant to Ohio Revised <br />Code 4909.34; and, <br /> <br /> WHEREAS, the P.U.C.O. has threatened to penalize <br />Garfield Heights with the legal costs beyond those incurred for <br />defending the soundness of a rate ordinance; and, <br /> <br /> WHEREAS, any sanctions on a municipality for exercising <br />its home rule authority will have a chilling effect on the Ohio <br />Constitution;'now, therefore; <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council of the City of Lakewood <br />hereby supports the City of Garfield Heights in its efforts to <br />reduce the electric rates to its residents and commercial <br />interests. <br /> <br /> Section 2.
