RESOLUTION NO 7098-95 <br /> <br />By~ Boscia, Flannery, George, <br /> Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY RESOLUTION to establish the date for holding the <br /> first meeting of Councll in 1996 as January 2, 1996, at 7'30 p m <br /> <br /> WHEREAS, Article III, Section 4 of the Amended Chmer of the ~ity of <br />Lakewund provides that Council shall meet the first Monday in January following each <br />regular Municipal election for the purpose of electing its officers for the nex~ two years, <br />and <br /> WHEREAS, in ~996, the first Monday in January is such a date following <br />~:regular Municipal election and falls on a national, state and City holiday, namely New <br /> ears Day, and <br /> <br /> x*~rlEREAS, the only business that is required to be conducted at such <br />meeting is the election of Council officers, and <br /> <br /> WHEREAS~ it is generally provided that ~vhbn an official date for the <br />taking of such action under law falls upon a declared holiday, the date for such action shall <br />be the next following day, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and for the usual <br />daily operation of a municipal department; now therefore, <br /> <br />OHIO' BE IT RESOLVED BY TStE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section I That this Council hereby declares that it is in the public interest <br />that the fa-st meeting in I996 be held on Tuesday, January 2, 1996, at 7:30 p m in the City <br />Hall Council Chambers both for the purpose of election of officers and the conducting of <br />ordinary business to come before City Council in sccordance with the published agenda. <br /> <br /> Section 2 It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open meeting <br />of this Cmmcil, and that all such deliberations of this Council and of any of its comnlitt~es <br />that resulted in such formal action were in meetings open to the public in compliance with <br />all legal requirements <br /> <br /> Section 3 That this resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote oftwo4hirds of all members elected to Council, it shall take effect and be <br />in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force afier the earliest period allowed by law <br /> <br />Adopted, ~~ <br /> <br />PRESIDENT <br /> <br /> CLERK <br /> <br />Approved' ~-ffce,.4.~.~.~ 2~/~/~ ?d~ ~ ~'~' <br /> <br /> <br />
