Amended <br />S/lS/00. <br /> <br />RESOLUTION: 7478-00 BY: Corrigan, FitzGerald, George= <br /> Seelie, Smith. <br /> <br /> A RESOLUTION declaring it necessary to improve Edgewater Drive <br />(from Parkside Drive to Wilbert Drive) by the deep grinding of the existing <br />asphalt surface course and the replacement of that surface with reinforced <br />asphalt pavement. <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO; <br /> <br /> Section 1. That it is necessary to improve the following streets in the <br />City of Lakewood: <br /> <br />Edgewater Drive (from Parkside Drive to Wilbert Drive) <br /> <br /> Section 2. That said Edgewater Drive (from Parkside Drive to Wilbert <br />Drive) shall be improved in accordance with specifications hereinafter <br />referred to and now on file in the office of the City Engineer that describe the <br />deep grind of the existing asphalt surface course and the replacement of <br />same with reinforced asphalt pavement. <br /> <br /> Section 3. It is hereby determined and declared that said <br />improvement is conducive to the public health, convenience and welfare of <br />said City and the inhabitants thereof. <br /> <br /> Section 4. That the plans, specifications and estimates of the <br />proposed improvements heretofore prepared and now on file in the office of <br />the City Engineer are hereby approved. <br /> <br /> Section 5. Council hereby determines that the lots and lands <br />abounding and abutting upon the proposed improvements are specifically <br />benefited by said improvements shall be assessed at a rate not to exceed <br />$25.00 per foot of frontage based upon an assessment rate of not greater <br />than twenty (20) percent of the cost of the project from the curb to. the <br />centerline of street. Those lots with side yards benefited by any of the said <br />improvements shall be assessed an amount equal to the average for all lots <br />having frontage on the improved portion of the street, plus an amount not to <br />exceed $25.00 per foot for any lot depth in excess of 150 feet. The <br />assessments shall cover twenty (20) percent of the actual cost of said <br />improvement, to wit: the cost of preliminary and other surveys, publishing <br />notices, resolutions and ordinances, the amount of damages resulting from <br />the improvement assessed in favor of any owner of land affected by the <br />improvement and the preparation, levy, and collection of the special <br />assessments, the cost of purchasing appropriating, and otherwise acquiring <br />labor and material, together with all other necessary expenditures. Such <br />amount being hereby determined to be equal to the special benefit derived <br />by lands so abounding and abutting these improvements. <br /> <br /> Section 6. That the Clerk of this Council be and she is hereby <br />directed to deliver a certified copy of this resolution to the Director of Finance <br />of this City. <br /> <br /> <br />
