RESOLUTION: 7478-00 A BY: Corrigan, FitzGerald, George, Roth, Seelie, Skindell A RESOLUTION amending Resolution No. 7478-00 for the purpose of removing language declaring it necessary for the assessment of property owners for certain street improvements. BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO; Section 1. That Resolution No. 7478-00 currently reading as follows: Section 1. That it is necessary to improve the following streets in the City of Lakewood: Edgewater Drive (from Parkside Drive to Wilbert Drive) Section 2. That said Edgewater Drive (from Parkside Drive to Wilbert Drive) shall be improved in accordance with specifications hereinafter referred to and now on file in the office of the City Engineer that describe the deep grind of the existing asphalt surface course and the replacement of same with reinforced asphalt pavement. Section 3. It is hereby determined and declared that said improvement is conducive to the public health, convenience and welfare of said City and the inhabitants thereof. Section 4. That the plans, specifications and estimates of the proposed improvements heretofore prepared and now on file in the office of the City Engineer are hereby approved. Section 5. Council hereby determines that the lots and lands abounding and abutting upon the proposed improvements are specifically benefited by said improvements shall be assessed at a rate not to exceed $25.00 per foot of frontage based upon an assessment rate of not greater than twenty (20) percent of the cost of the project from the curb to the centerline of street. Those lots with side yards benefited by any of the said improvements shall be assessed an amount equal to the average for all lots having frontage on the improved portion of the street, plus an amount not to exceed $25.00 per foot for any .lot depth in excess of 150 feet. The assessments shall cover twenty (20) percent of the actual cost of said improvement, to wit: the cost of preliminary and other surveys, publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the preparation, levy, and collection of the special assessments, the cost of purchasing appropriating, and otherwise acquiring labor and material together with ail other necessary expenditures. Such amount being hereby determined to be equal to the special benefit derived by lands so abound lng and abutting these improvements. Section 6. That the Clerk of this Council be and she is hereby directed to deliver a certified copy of this resolution to the Director of Finance of this City.
