RESOLUTION NO. 7525-00 BY:Corrigan, FitzGerald, George, Seelie, Skindell, Smith. AN EMERGENCY RESOLUTION objecting to the transfer of ownership of D5 and D6 liquor permits from Detroiter Inc. D/B/A Detroiter Restaurant to Detroiter Inc. D/B/A Detroiter Kestaurant for an establishment located at 14051 Madision Avenue, City of Lakewood, Ohio 44107. WHEREAS, the City has been advised that an application has been filed with the Ohio Departrnent of Liquor Control to transfer the ownership olD5 and D6 liquor permits from Detroiter Inc. D/B/A Detroiter Restaurant to Detroiter Inc. D/B/A Detroiter Restaurant.for an establishment located at 14051 Madision Avenue, Lakewood, Ohio; and WHEREAS, this Council determines that the place for which the perrait is sought is situated within 500 feet of a school and that the operation of the liquor establishment will substantially and adversely affect or interfere with the normal, orderly conduct of the affairs of the school; and WHEREAS, this Council has been advised that the applicant has no intention of establishing a liquor establishment at 14051 Madison Avenue, Lakewood, Ohio; and WHEREAS, this resolution constitutes an emergency measure in that it provides for the immediate preservation of the public health, safety and welfare; now therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEwooD, STATE OF OHIO: Section 1. That the Council hereby strenuously objects to the transfer of ownership by the Department of Liquor Control of the State of Ohio of the D5 and D6 liquor permits from the premises known as Detroiter Inc. D/B/A Detroiter Restaurant to Detroiter Inc. D/B/A Detroiter Restaurant for an establishment located at 14051 Madision Avenue, Lakewood, Ohio for the reasons set forth above all in accordance with the provisions of Section 4303.292 of the Revised Code of Ohio. Section 2. That the Clerk of Council is' hereby authorized and directed to forward a certified copy of this Kesolution together With a letter requesting that the hearing be held in Cleveland, Cuyahoga County, Ohio, to the Department of Liquor Control, State of Ohio, Permit Division, forthwith. Section 3. That this Council designates the Law Department of the City of Lakewood to represent it and the City of Lakewood at any heatings before the Department of Liquor Control. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 5. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the aiTmnative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its Ro th,
